Construction Services Agreement <br />REV: 04-26-2021 PR <br />00 5205 - 28 <br /> <br /> <br />Noncompliance with HUD's regulations in 24 CFR part 75 may result in sanctions, <br />termination of this contract for default, and debarment or suspension from future <br />HUD assisted contracts. <br />With respect to work performed in connection with Section 3 covered Indian <br />housing assistance, section 7(b) of the Indian Self-Determination and Education <br />Assistance Act (25 U.S.C. 450e) also applies to the work to be performed under <br />this contract. Section 7(b) requires that to the greatest extent feasible (i) preference <br />and opportunities for training and employment shall be given to Indians, and (ii) <br />preference in the award of contracts and sub contracts shall be given to Indian <br />organizations and Indian-owned Economic Enterprises. Parties to this contract that <br />are subject to the provisions of section 3 and section 7(b) agree to comply with <br />section 3 to the maximum extent feasible, but not in derogation of compliance with <br />section 7(b). <br />L. Compliance with IC22-5-1.7 – E-Verify Program. <br /> <br />The Contractor must enroll in and verify the work eligibility status of all newly hired employees of <br />the Contractor through the E-Verify program operated by the United States Department of <br />Homeland Security. If the E-Verify program ceases to exist, the Contractor will not be required to <br />verify the work eligibility status of newly hired employees through the E-Verify program. The <br />Contractor shall execute an affidavit affirming that the Contractor has enrolled in and is <br />participating in the E-Verify program and affirming that the Contractor does not knowingly employ <br />an unauthorized alien. <br />M. Prohibition of Contracting with Businesses that Invest in Iran. <br /> <br />For the duration of the Term of this Agreement, Contractor hereby certifies under penalties of <br />perjury that it does not engage in investment activities in Iran as more particularly described in <br />Indiana Code 5-22-16.5. <br />N. Environmental. <br /> <br />The Contractor agrees to comply with the provisions of the National Environmental Policy Act of <br />1969 (NEPA) (42 U.S.C. 4321 et. seq.) as it applied at 24 CFR 58, including any requirements <br />which may be imposed by the City as a result of its responsibility for environmental review, <br />decision making, and action under NEPA. <br />The Contractor shall provide to the City all information necessary to complete an Environmental <br />Assessment and a Section 106 Review. Such information shall be provided before the <br />commencement of any activity provided for herein. All renovations must be approved through the <br />Section 106 Historic Review Process before execution of any rehabilitation contracts. <br />O. Prohibition of and Elimination of Lead-Based Paint Hazards.
