Construction Services Agreement <br />REV: 04-26-2021 PR <br />00 5205 - 38 <br /> <br /> <br /> All work site hours must be reported. Owner operators must be listed on Prime's <br />payroll, i.e., painting, fencing, layers of floor covering. Maximum of five (5) <br />owners/company each must have minimum 20% ownership, Labor Standards Act. <br /> d) The term "wages" means the basic hourly rate of pay, any contribution made <br />pursuant to, or costs anticipated to provide, a bonafide fringe plan, fund or program. <br /> e) The “payment of wages” shall be by cash, negotiable instruments payable on <br />demand, or the additional forms of compensation for which deductions are <br />permissible under the Regulations. No other means of payment shall be recognized. <br /> <br />10. Subcontractors <br /> a) The contractor, his subcontractors and any lower-tier subcontractors shall insert <br />HUD Form 4010, "Federal Labor Standards Provisions", in any subcontracts into <br />which they may enter. The contractor shall not thereby be relieved of responsibility <br />for the compliance of any subcontractor with these conditions. <br />11. Contractor/Subcontractor Certifications <br /> a) The contractor and each subcontractor is required to submit with, or prior to their <br />first payroll, the following certifications (a copy of each is attached): <br /> 1) Certification of Understanding and Authorization which certifies that proper <br />officials have read and understand the Minutes of the Preconstruction <br />Conference on Labor Standards Provisions and Related Matters; and <br />identifies the person(s) who is authorized to sign the weekly certified payroll <br />reports. <br /> 2) Certification for Applicable Fringe Benefit Payments which identifies the <br />method by which the contractor/subcontractor will meet any obligation for <br />fringe benefits which may be contained in the wage decision, and any plans, <br />funds, or programs, to which such payments will be made. <br />b) Internal Revenue Service Employer Identification Number - This assigned number must be <br />furnished by each subcontractor on their first payroll report. <br />12. Weekly Certified Payroll Reports and Related Records <br /> a) Public Work Payroll Reporting Form is available at the California Department of <br />industrial Relation website - https://www.dir.ca.gov/dlse/Forms/PW/DLSEFormA- <br />1-131.pdf . <br /> b) The weekly certified payroll reports and basic records relating thereto (e.g., <br />timecards, cancelled payroll checks) shall be maintained during the course of the <br />work and preserved for a period of three years thereafter for all labor which is
