You have asked <br />that the Silicon Valley Clean Water Joint Powers Authority ("SVCW") consent to a proposed vacation of <br />a 30 foot wide section of the existing Maple Street public right of way and to accept a 15 foot wide private <br />easement immediately adjacent to what will be the remaining 50 foot Maple Street public roadway in the <br />after condition. Your plan will provide a total 65 foot width for accessing SVCW's existing pipeline and <br />facilities within Maple Street, in lieu of the existing 80 foot public right of way width. <br />You are aware that SVCW owns and operates an existing 48" diameter sanitary sewer force main and <br />appurtenances within Maple Street and requires that adequate clearance for future access, maintenance, and <br />repair of said pipeline and facilities be maintained. You have provided plans indicating that you will be <br />placing additional fill to the Maple Street right of way, the proposed easement area, and your development <br />site, which will make it more costly for SVCW to reach its pipeline for future maintenance and repairs. <br />You are also adding structures in closer proximity to SVCW's existing facilities, making future access and <br />construction more expensive as additional shoring and safety precautions will be required to conduct <br />maintenance and repair work within the constricted arca. And finally, certain existing SVCW facilities <br />such as valves will need to be modified to accommodate your project development plans. <br />This is to confirm that SVCW will consent to the proposed vacation of a 30' wide portion of the Maple <br />Street right of way and will accept the offered 15' wide private replacement easement under the following <br />terms and conditions: <br />1. Reservation of Easement- Easement rights in favor of SVCW must be reserved from the proposed <br />public road vacation. This easement will be for the protection of the existing pipeline and <br />appurtenant facilities within Maple Street and for use in conjunction with future maintenance and <br />repair needs. Provisions will require that in conjunction with SVCW's future repair and <br />replacement projects, the developer and their successors shall be responsible for any added costs <br />of removing and replacing any features added by the pending development within the Maple Street <br />ATTY/RESO.0006/CC RESO TO VACATE RIGHT OF WAY A PORTION OF MAPLE ST.
