02/08/2021 <br />RESOLUTION NO. 15934 <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDWOOD <br />CITY VACATING A PORTION OF MAPLE STREET PUBLIC RIGHT-OF- <br />WAY IN THE CITY OF REDWOOD CITY PURSUANT TO PART 3 OF <br />DIVISION 9, CALIFORNIA STREETS AND HIGHWAYS CODE OF THE <br />STATE OF CALIFORNIA <br />WHEREAS, on May 7, 2018, the City Council of the City of Redwood City ("City <br />Council") approved a 131 -unit townhouse development at 1548 Maple Street (the <br />"Project"), and on May 21, 2018, the City Council adopted an ordinance approving a <br />Development Agreement ("DA") between the City of Redwood City and the developer, <br />Strada Investment Group, as part of the Project; and <br />WHEREAS, pursuant to the provisions of Part 3 (commencing at Section 8300) <br />of Division 9 of the California Streets and Highways Code, the City Council intends to <br />vacate the public right-of-way being a portion of Maple Street as shown on Parcel Map <br />No. 91 — 10 in Book 67 of Parcel Maps, at Pages 26-27, in the office of the Recorder for <br />the County of San Mateo, attached hereto and incorporated by reference as Exhibit 1; <br />and <br />WHEREAS, pursuant to said provisions of the California Streets and Highways <br />Code, notice of intention to vacate the herein described portion of Maple Street as <br />shown on the Parcel Map No. 91 — 10 in Book 67 of Parcel Maps, at Pages 26-27, was <br />published and posted in substantially the form attached hereto and incorporated by <br />reference as Exhibit 2 (Public Hearing Notice), and notice was provided to property <br />owners within 300 feet; and <br />WHEREAS, the City sent various utility companies notice of its intention to <br />vacate in substantially the form attached hereto and incorporated by reference as <br />Exhibit 3 (Notice to Utilities); and <br />WHEREAS, the City held a public hearing on February 8, 2021 to hear evidence <br />offered by interested persons and to determine from all of the evidence submitted <br />whether the described portions of Maple Street right-of-way is unnecessary for present <br />or prospective public use. <br />NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF <br />REDWOOD CITY AS FOLLOWS: <br />1. The recitals set forth above are true and correct, and are hereby <br />incorporated herein by this reference as if fully set forth in their entirety. <br />2.
