<br />ATTY/RESO.0011/CC RESO FINDING THAT PROPERTY APN 053-187-010 IS EXEMPT SURPLUS LAND <br />REV: 02-28-2022 SK <br />Page 1 of 2 <br />RESOLUTION NO._____ <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDWOOD <br />CITY FINDING THAT THE PROPERTY IDENTIFIED AS APN 053-187-010 <br />(A ROAD MEDIAN COMMONLY REFERRED TO AS SHASTA <br />TRIANGLE) IS EXEMPT SURPLUS LAND PURSUANT TO <br />GOVERNMENT CODE SECTION 54221(f)(1)(B) <br /> <br />WHEREAS, the City of Redwood City (the “City”) owns that certain property <br />identified as APN 053-187-010 and more generally described as the triangular property <br />located at the intersection of Main Street, Shasta Street and Chestnut Street and currently <br />used as landscaped median ( the “Shasta Triangle”) in fee; and <br /> <br />WHEREAS, the Shasta Triangle consists of 757 square feet of land; and <br /> <br />WHEREAS, the Shasta Triangle is adjacent to property currently owned by <br />Benjamin Kopf Holding Co., which is property intended to be developed as part of a <br />mixed -use development including office, retail, open space, and residential uses; and <br /> <br />WHEREAS, the Surplus Land Act (Government Code Section 54220 et seq.) (the <br />“Act”) requires that local agencies, including the City, comply with the requirements of the <br />Act before disposing of surplus land unless the property is “exempt surplus land” as <br />defined in Government Code Section 54221(f); and <br /> <br />WHEREAS, Government Code Section 54221(f)(1)(B) includes in the definition of <br />Exempt Surplus Land, land that is less than 5,000 square feet that is sold to an owner of <br />contiguous land. <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF REDWOOD CITY <br />RESOLVES AS FOLLOWS: <br /> <br />Section 1. Evidentiary Basis: The City Council, having independently heard, <br />considered, and weighed all the evidence in the record, finds that the above recitals are <br />accurate and constitute findings in this matter and, together with the staff report have <br />served as an adequate and appropriate evidentiary basis for the findings and actions set <br />forth in this Resolution. <br /> <br />Section 2. Surplus Land: The City Council hereby designates the Shasta Triangle <br />as exempt surplus land on the following basis: <br /> <br />1. The Shasta Triangle is less than 5,000 square feet in size; and <br /> <br />2. The Shasta Triangle is being sold to Benjamin Kopf Holding Co., the owner <br />of contiguous land; and <br /> <br />6.C. - Page 5 of 6 <br />61
