Page 3 of 4 <br />City of Redwood City 1017 Middlefield Road, Redwood City, CA. 94063 Tel: 650-780-7000 www.redwoodcity.org <br />ANALYSIS <br />AB 361 allows local legislative bodies to continue to meet remotely in any of the following circumstances: <br />The legislative body holds a meeting during a proclaimed state of emergency, and state or local <br />officials have imposed or recommended measures to promote social distancing. <br />The legislative body holds a meeting during a proclaimed state of emergency for the purpose of <br />determining, by majority vote, whether as a result of the emergency, meeting in person would <br />present imminent risks to the health or safety of attendees. <br />The legislative body holds a meeting during a proclaimed state of emergency and has determined, <br />by majority vote, pursuant to subparagraph (B), that, as a result of the emergency, meeting in <br />person would present imminent risks to the health or safety of attendees. (Gov. Code § <br />54953(e)(1)(A)-(C).) <br />Staff has determined the following findings can be made to meet the above provisions of AB 361: <br />The state of California remains under the COVID-19 state of emergency proclaimed by the <br />Governor pursuant to the California Emergency Services Act. <br />The emergency continues to directly impact the ability of members to meet safely in person. <br />State or local officials continue to impose or recommend measures to promote social distancing <br />(Gov. Code § 54953(e)(3)(B)(i)-(ii).). <br />As described in the Background section, masks continue to be imposed in certain settings and continue to <br />be strongly recommended as a safety measure for all persons, regardless of vaccination status. Therefore, <br />social distancing measures are still applicable at this time. <br />Staff recommends that the City Council declare a continued state of local emergency and affirm the above <br />findings so that the City may continue to teleconference public meetings without adhering to all of the <br />Brown Act’s teleconferencing requirements, in order to ensure the health and safety of the public. <br />FISCAL IMPACT <br />There is no fiscal impact associated with adopting the proposed resolution. <br />ENVIRONMENTAL REVIEW <br />This activity is not a project under California Environmental Quality Act (CEQA) as defined in CEQA <br />Guidelines, section 15378, because it has no potential for resulting in either a direct or reasonably <br />foreseeable indirect physical change in the environment. <br />6.E. - Page 3 of 7 <br />87
