Code §27383 <br />LANDSCAPE MAINTENANCE AGREEMENT <br />1180 Main Street <br />THIS LANDSCAPE MAINTENANCE AGREEMENT ("Agreement") is made and <br />entered into this jCAay of MAP—c* , 2020 ("Effective Date"), by and between <br />Premia 1180 Main Owner, LLC, a Delaware limited liability company ("Developer"), and <br />the CITY OF REDWOOD CITY, a charter city and California municipal corporation ("City") <br />with reference to the following facts: <br />RECITALS <br />A. Reference is made to that certain real property situated in the City of <br />Redwood City, County of San Mateo, State of California, known as the 1180 Main Street <br />Project ("Site") and described on Exhibit "A", attached hereto and incorporated by this <br />reference as if fully set forth herein (the "Property'). The Property is being developed as <br />an office project. <br />B. On July 30, 2019, the Planning Commission of the City of Redwood City <br />adopted, among other approvals, Resolution No. 19-10, approving a Tentative Parcel <br />Map (TM2.018-006) to develop the Property as three-story, 109,375 square foot office <br />building ("Project"), subject to certain conditions of approval ("Conditions"). Condition No. <br />22(c) requires that at the time of the approval of the parcel map, Developer enter into a <br />Landscape Maintenance Agreement with City providing for the Developer's long-term <br />maintenance of the Improvements within the Maintenance Area. <br />C. Developer submitted to City plans, specifications, and drawings entitled <br />1180 Main Street Improvement Plans, prepared by BKF Engineers and dated <br />MA-Kc4 la,2-o`ww ich include, inter alia, landscaping plans for along the Property frontage <br />("Plans'), all of which Plans have been approved by City. The Plans provide for <br />installation of certain landscaping, pedestrian lighting, irrigation, sidewalks, street trees, <br />and paths ("Improvements") within the Lathrop, Elm, Main, and Maple Street frontages, <br />as well as along the northeastern side of the site, adjacent to the railroad tracks <br />("Maintenance Area").
