Additional terms: <br />City employees, volunteers, patrons, or other associated personnel will make <br />reasonable efforts not to come within 20 feet of the beehives without a representative <br />of Consultant being present. If City maintenance, repairs, or other services need to be <br />performed near the hives, City shall provide 72 hour's notice via email or phone to <br />Consultant so arrangements can be made to ensure the safety of the personnel <br />involved as well as the honeybees. In the case of emergencies requiring immediate <br />attention by maintenance personnel, Consultant agrees to provide a beekeeper with <br />less than 72 hour's notice. The foregoing notwithstanding and without limiting the <br />generality of Section 5 of the Agreement, City may take any actions it deems <br />necessary in case of emergency or to protect the health and safety of any person <br />without consulting or providing notice to Consultant and without liability to Consultant. <br />REV: 01-28-2021 RL <br />ATTY/AGR.2021/Amend No.1/Kendal's Bees (Page 4 of 4) <br />
