From "th'e Executive'Director. <br /> <br />October 26, 2009 <br /> <br />SUBJECT <br />Keyser Marston Associates Consultant Services Agreement Amendment NO.5 <br /> <br />RECOMMENDA rlON <br />Approve, by motion, Amendment No. 5 to the Agreement with Keyser Marston <br />Associates (KMA) for financial consulting services, modifying the hourly fee schedule to <br />reflect appropriate rates for different services. <br /> <br />BACKGROUND <br />The Agency approved Amendment No. 4 to the consultant contract with KMA for <br />professional planning and redevelopment financial consulting services on September <br />14, 2009, authorizing ongoing services, as needed, for a not-to-exceed amount of <br />$60,000. <br /> <br />KMA provides services to the Agency related to advice with respect to marketing, <br />financial, land assembly and land disposition issues. Amendment No. 4 included an <br />hourly fee schedule that was specific to the preparation of the Five Year Implementation <br />Plan, one of the nine services included in the Scope of Services (Exhibit A). A different <br />schedule of fees applies to the other services identified in the Scope of Services. <br /> <br />Amendment No.5 clarifies the different rate schedules, with Exhibit B specifying the <br />rates for all services except those related to the preparation of the five year <br />implementation plan and Exhibit C specifying the rates for the assistance related to the <br />five year implementation plan. The rates for the preparation of the five year <br />implementation plan (Exhibit C) are lower than the rates for the "other services". <br />However, it is important to note that the rates for "other services" specified in Exhibit B <br />are consistent with previous amendments and contracts and have not been raised for <br />several years. <br /> <br />AL TERNA riVES <br />Do not approve the amendment and correction to the rate schedule. <br /> <br />FISCAL IMPACT <br />None. Amendment No. 5 simply modifies the agreement to clarify the different rates <br />schedules for different services. It has no impact on the total not-to-exceed contract <br />compensation authorized by Amendment NO.4. <br />
