REV: 08-04-22 MI EXHIBIT “A” SCOPE OF SERVICES AND FEE I. Scope of Services Consultant will provide services related to the claim submitted by contractor, Joseph J. Albanese, Inc., regarding the City’s U.S. Highway 101 Pedestrian Undercrossing Project (“Claim”), including review and analysis of the time impact analysis submitted with the Claim, and a preliminary assessment of liability for project delay, including liability for liquidated damages or compensable delay, for purposes of informing the City’s written response to the Claim. Upon request by the City Attorney’s Office, the Services may also include but shall not be limited to entitlement and cost analysis with respect to the Claim, and may extend to consultation before or during the meet and confer on the Claim, and assistance with preparing for and representing the City at mediation of the Claim if the Claim progresses to those stages. Consultant will summarize the findings of its analyses in a written report and/or a graphic presentation customized to the needs of the City, including: a report that includes summary level discussions supported by detailed analyses and supporting documentation; summary level reports to management; and/or computer-aided presentations of key issues, schedule delays and cost overruns. All Services are to be provided to the City Attorney’s Office, which will include working directly with outside counsel on analysis of the Claim and preparing the City’s written response to the Claim. As such all Services will be subject to evidentiary protections under the attorney work product doctrine and/or attorney-client privilege, and all writing communications should be appropriately marked to preserve those protections. Key personnel on this project are Constance Riedinger and Steve Delaney. II. Fee Schedule Fees will be billed on an hourly basis based on actual hours worked per the rate schedule below. Consultant will be reimbursed for all reasonable and pre-approved expenses actually incurred.
