Levaggi, was the original TRUSTOR and FIDELITY NATIONAL TITLE INSURANCE COMPANY, A CORPORATION, the original TRUSTEE, and the CITY OF REDWOOD CITY, A MUNICIPAL CORPORATION, the original BENEFICIARY of the certain Deed of Trust titled SHORT FORM DEED OF TRUST AND ASSIGNMENT OF RENTS dated February 6, 2001, and recorded as Instrument Number 2001-019162 on February 14, 2001 in Official Records of the County of San Mateo, State of California (the "Deed of Trust'); and WHEREAS, the Deed of Trust irrevocably granted, transferred and assigned to the original Trustee in Trust, with power of sale, the property in San Mateo County, California, with the address of 3290-3296 Rolison Road, Redwood City, California and more particularly described in Exhibit "A", attached hereto and incorporated by reference (the "Property"); and WHEREAS, the Deed of Trust secured (1) the performance of each agreement of original Trustor incorporated by reference or contained therein;(2) financial assistance (the "Loan") to the original Trustor with the principal sum of Two Hundred Thousand & No/100 Dollars ($200,000.00), which the original Trustor promised to pay to the original Beneficiary with interest as described in the Promissory Note (the "Promissory Note"); and (3) payment of any further sums the original Trustor may borrow from original Beneficiary; and WHEREAS, the agreements have been performed and the Loan has been fully repaid, and the undersigned successor Beneficiary desires to substitute itself as the new Trustee under said Deed of Trust and in place and instead of FIDELITY NATIONAL TITLE INSURANCE COMPANY, A CORPORATION. NOW THEREFORE, the undersigned hereby substitutes the CITY OF REDWOOD CITY, A MUNICIPAL CORPORATION, as Trustee under said Deed of Trust, and the CITY OF REDWOOD CITY, A MUNICIPAL CORPORATION, as the substituted Trustee does hereby reconvey, without warranty, to the person or persons legally entitled thereto, the Estate now held thereunder.
