2. Property Subject to Agreement. The Property will be subject to this Agreement. 3. Duty to Install Improvements. 3.1 Developer will construct, install and complete, or cause to be constructed, installed and completed, at Developer's sole cost and expense, the Improvements, in accordance with(1) the Improvement Plans, as such Plan may be modified as provided in this Agreement; (2) all requirements of State and local law, including the City of Redwood City Municipal Code; (3) the Conditions; (4) any applicable mitigation measures and (5) to the satisfaction of the City Engineer, in their reasonable discretion. Developer will also supply all labor and materials therefor, all in strict accordance with the terms and conditions of this Agreement. The Improvements will include all Improvements shown on the Improvement Plans, but are not necessarily limited to, all of the following: REV: 04-07-2022 SK (a) grading, paving; (b) curbs, gutters, concrete walkways, driveways; (c) sanitary sewer system; (d) domestic and recycled water systems; (e) storm drainage system; (f) site lighting system; (g) street trees; (h) landscaping and irrigation system; (i) utility joint trenching; (j) park improvements including the Main Street Dog Park Improvements; (k) Community garden improvements consistent with the Community Garden Plans; (1) all other improvements, both on-site and off-site included in the Conditions of the Tentative Map; and (m) all other work, improvements, or construction required by or specified in the Improvement Plans, the Conditions or any other approvals from the City and all construction, appurtenances and improvements necessary as reasonably determined by the City Engineer to complete the aforementioned improvements, both within and outside of the Property.
