Code §27383 <br />SUBDIVISION IMPROVEMENT AGREEMENT <br />1417 MIDDLEFIELD ROAD <br />THIS SUBDIVISION IIMPROVE ENT AGREEMENT ("Agreement") is made and <br />entered into on this day ofll zk n ,ISI022 ("Effective Date") by and between <br />NOVENTI QOZ PROPERTIES LLC, a California limited liability company ("Developer"), <br />and the CITY OF REDWOOD CITY, a charter city and California municipal corporation <br />("City") (together, the "Parties") with reference to the following facts: <br />RECITALS <br />A. Developer is the current fee owner of that certain real property consisting of <br />approximately 0.35 acres located within the City of Redwood City, County of San Mateo, <br />State of California, described in Exhibit "A", attached hereto and incorporated herein by <br />reference (the "Property"). <br />B. On November 16, 2021, the Planning Commission of the City of Redwood <br />City adopted, among other approvals, Resolution No. 21-12, approving the Tentative <br />Parcel Map for the 1417 Middlefield Road Subdivision ("Project"), prepared by L. Wade <br />Hammond Civil Engineering & Land Surveying and dated April 19, 2021 ("Tentative <br />Parcel Map"), subject to certain conditions of approval ("Conditions"). <br />C. The Conditions require either (1) that certain public improvements for the <br />Project be constructed prior to approval of the parcel map ("Parcel Map"), or (2) that <br />Developer enter into an agreement with City providing for the future construction of such <br />public improvements. <br />D. Developer has submitted the Parcel Map and applied to City for Parcel Map <br />approval without having completed the required public improvements and, therefore, will <br />enter into an agreement with City providing for the future construction and installation of <br />such public improvements, as required by Government Code section 66411.1. <br />E. Developer has submitted to City plans, specifications and drawings entitled <br />1417 Middlefield Field Road Improvement Plans, prepared by L. Wade Hammond Civil <br />Engineering & Land Surveying and dated July 14, 2022 (the "Improvement Plans"), which, <br />in addition to other improvements, provide for certain on-site public improvements <br />consisting of street and street light improvements, storm drain systems, domestic water <br />systems and sanitary sewer systems for the Project (collectively, "Improvements"). <br />REV: 09-22-2022 SK <br />ATTY/AGR.2022.358/Noventi Qoz Properties LLC (Page 1 of 22) <br />
