City and Owner are sometimes referred to herein <br />individually as a "Party" and collectively as the "Parties." <br />RECITALS <br />A. These Recitals refer to and utilize certain capitalized terms which are defined in <br />Article 1 of this Agreement. The Parties intend to refer to those definitions in connection with <br />the use of capitalized terms in these Recitals. <br />B. The City and Harbor View Property LLC ("Developer") entered into that certain <br />Development Agreement dated , 202_ (the "Development Agreement"), whereby the City <br />and Developer established and documented certain development rights and obligations pertaining <br />to property owned by Developer. <br />C.
