Code § <br />27383. <br />IMPROVEMENT AGREEMENT <br />242 Walnut Street <br />THI IMPROVEMENT AGREEMENT ("Agreement") is made and entered into on <br />this day o ftl 202g ("Effective Date") by and between PBA II LLC, a Delaware <br />limited liab li camp y ("Developer"), and the CITY OF REDWOOD CITY, a charter city <br />and California municipal corporation ("City") (together, the "Parties") with reference to the <br />following facts: <br />RECITALS <br />A. Developer is the current fee owner of that certain real property consisting of <br />approximately 6.8 acres located within the City of Redwood City, County of San Mateo, <br />State of California, described in Exhibit "A", attached hereto and incorporated herein by <br />reference (the "Property"). <br />B. On July 7, 2008, the City Council of the City of Redwood City adopted <br />Ordinance No. 2335 for required use of recycled water. Existing commercial properties in <br />the Recycled Water Service Area are required to use recycled water for landscape <br />irrigation. <br />C. On August 26, 2019, the City Council of the City of Redwood City adopted <br />Resolution No. 15796 establishing the Green Infrastructure Development Standards ("GI <br />Standards"). The GI Standards guide the City's implementation of the City's Green <br />Infrastructure requirements (codified in Chapters 18, Article XIV and 27A, Article II of the <br />City's Municipal Code), which require Developer to construct permanent stormwater <br />pollution prevention measures ("PSPPM") in connection with the substantial commercial <br />remodel of the Property's buildings, as specified. <br />D.
