license to the general public; (iii) has not been offered, sold, leased, or licensed to the <br />public but will be available for commercial sale, lease, or license in time to satisfy the <br />delivery requirements of this Contract; or (iv) satisfies a criterion expressed in (i), (ii), or <br />(iii) above and would require only minor modifications to meet the requirements of this <br />Contract. <br />h) “Contract” means this Contract or agreement (including any purchase order), by <br />whatever name known or in whatever format used. <br />i) “Custom Software” means Software that does not meet the definition of Commercial <br />Software. <br />j) “Contractor” means the Business Entity with whom the State enters into this Contract. <br />Contractor shall be synonymous with “supplier,” “vendor” or other similar term. <br />k) “Data Processing Subsystem” means a complement of Contractor furnished individual <br />Machines, including the necessary controlling elements (or the functional equivalent), <br />operating Software and Software, if any, which are acquired to operate as an integrated <br />group, and which are interconnected entirely by Contractor supplied power and/or signal <br />DGS PD 401IT (REVISED AND EFFECTIVE 9/5/14) <br />GENERAL PROVISIONS – INFORMATION TECHNOLOGY <br />Page 2 of 28 <br />cables, e.g., direct access controller and drives, a cluster of terminals with their controller, <br />etc. <br />l) “Data Processing System (System)” means the total complement of Contractorfurnished Machines, <br />including one or more central processors (or instruction processors), <br />Operating Software which are acquired to operate as an integrated group. <br />m) “Deliverables” means Goods, Software, Information Technology, telecommunications <br />technology, Hardware, and other items (e.g. reports) to be delivered pursuant to this <br />Contract, including any such items furnished incident to the provision of services. <br />n) “Designated CPU(s)” means for each product, if applicable, the central processing unit <br />of the computers or the server unit, including any associated peripheral units.
