and approved thereunder, for each and every such violation and <br /> noncompliance, respectively, shall be guilty of an infraction and, shall be <br /> punishable by: <br /> <br /> 1. A fine not exceeding one hundred dollars ($100.00) for a first violation; <br /> and <br /> <br /> 2. A fine not exceeding two hundred dollars ($200.00) for a second <br /> violation of the same provision within one year from the date of the first <br /> violation; and <br /> <br /> 3. A fine not exceeding five hundred dollars ($500.00) for each additional <br /> violation of the same provision within one year from the date of the first <br /> violation. <br /> <br /> The imposition of any one penalty for any violation shall not excuse the <br /> violation or permit to continue. Each and every day a violation shall continue <br /> shall be deemed to be a separate violation. <br /> <br />B. Use of the enforcement procedures of this section will be at the sole discretion of <br /> the Fire Chief, the Chief of the Bureau of Fire Prevention or their designees and <br /> will not limit or preclude the use of any other enforcement measures pursuant to <br /> this Code, State or Federal law. <br /> <br />C. The Fire Chief or his authorized representatives shall enforce the provisions of <br /> the Fire Code adopted by Section 12.7 and as amended by this Article and all <br /> orders, licenses, certificates, permits and plans and specifications issued or <br /> approved thereunder and shall have the authority to issue citations for violations <br /> thereof." <br /> <br />SECTION 3. All former ordinances or parts thereof conflicting or inconsistent with the <br />provisions of this ordinance or of the Code hereby adopted, are hereby repealed. <br /> <br />SECTION 4. If any section, paragraph, sentence or word of this ordinance or of the <br />Code hereby adopted should for any reason, be found invalid, it is intended that all <br />other portions of this ordinance independent of any such portion as may be declared <br />invalid shall be valid. <br /> <br />SECTION 5. This Council finds and determines that pursuant to Section 50022.1 of the <br />Government Code, the City is authorized to adopt the Uniform Fire Code by reference <br />and amend same by ordinance. Section 18941.5 of the Housing and Safety Code <br />provides in part that the ordinance adopted by local entities must take effect 180 days <br />after the publication of the Model Ordinance published by the California Building <br />Standards Commission ("Commission"). The date by which the ordinance must take <br />effect is November 1, 2002. In the event that the Ordinance does not take effect by <br />November 1, 2002, the Uniform Fire Code, as adopted by the Commission, will be in <br />full force and effect in the City of Redwood City.
