�1� <br />First American Title <br />NCS -1165425-5C <br />RECORDING REQUESTED BY AND <br />WHEN RECORDED MAIL TO: <br />City of Redwood City <br />1017 Middlefield Road <br />Redwood City, CA <br />94063 Attention: City <br />Cleric <br />NO FEE FOR RECORDING <br />PURSUANT TO GOVERNMENT <br />CODE SECTION 27383 <br />APN: 059-172-150 <br />REGULATORY AGREEMENT AND DECLARATION <br />OF RESTRICTIVE COVENANTS <br />(86 Renato Court) <br />This REGULATORY AGREEMENT AND .DECLARATION OF RESTRICTIVE <br />COVENANTS (the "Agreement") is made and entered into as of March 24 , 2023, by and <br />between the CITY OF REDWOOD CITY, a California charter city and municipal corporation (the <br />"City") and SAINT FRANCIS CENTER OF REDWOOD CITY, a California nonprofit public <br />benefit corporation (the "Owner"). City and Owner are sometimes referred to herein individually <br />as a "Party" and collectively as the "Parties." <br />A. These Recitals refer to and utilize certain capitalized terms which are defined in <br />Article 1 of this Agreement. The Parties intend to refer to those definitions in connection with the <br />use of capitalized terms in these Recitals. <br />B. The City and Harbor View Property LLC ("Developer") entered into that certain <br />Development Agreement dated December 28, 2022 (the "Development Agreement"), whereby <br />the City and Developer established and documented certain development rights and <br />obligations pertaining to property owned by Developer. <br />C. Pursuant to the Development Agreement, Developer has agreed to sell other real <br />property owned by Developer located at 86 Renato Court, APN 059-172-1.50 (the "Property") to <br />Owner, consisting of fourteen (14) affordable units, 100% of which will be affordable to Extremely <br />Low Income Households (the "Inclusionary Units"), which must conform with City Zoning Code <br />Article 29 (Requirements for Affordable Housing). <br />D.
