ATTY/RESO.0028/PC RESO APPROVING 1201 MAIN WITH CONDITIONS OF APPROVAL <br />REV: 04-18-23 VR <br />Page 14 of 34 <br />Based on substantial evidence, the proposed Affordable Housing Plan <br />contains an alternative percentages and levels of affordability that will <br />provide as many or more affordable units at the same or lower income levels <br />or will otherwise provide greater public benefit than the standard <br />requirement. <br />The proposed affordable units mitigate the project’s impact on the need for <br />affordable housing by providing fifteen (15%) of the base units as affordable onsite, <br />or four total (4) units, but at lower income levels than what is specified in Section <br />29.4.A.1 and paying an in-lieu fee for fractional units. Of the four units, the project <br />proposes one fewer moderate unit than required but an additional unit at the low <br />income level. These units are comprised of one moderate unit (one-bedroom); two <br />low-income units (a studio and a one-bedroom); and one very-low-income unit (a <br />one-bedroom). The project will also pay an in-lieu fee of $68,703.80 for fractional <br />units. Because the project proposes more affordable units at a lower income level, <br />there is substantial evidence to support a determination under Section 29.4(A)(1) <br />that the project’s alternative percentages will provide more affordable units at a <br />lower income level. Moreover, the additional unit at the lower income level provides <br />a greater public benefit than the standard requirements since it is generally more <br />difficult to provide sufficient housing at the lower affordability levels. <br /> <br />Section 7. The Planning Commission hereby approves the Architectural Permit, <br />Conditional Use Permit, Tentative Parcel Map, and Affordable Housing Plan subject to the <br />Conditions of Approval (Exhibit A) attached and incorporated by reference. <br /> <br />Section 8.
