BAYSHORE – EXHIBIT B <br />REV: 05-12-23 JB <br />Page 15 of 22 <br />Mitigation Monitoring or Reporting Program <br />505 East Bayshore Road Project (SCH #2021080447) <br />Impacts Mitigation Timeframe for <br />Implementation <br />Responsibility <br />for <br />Implementation <br />Oversight of <br />Implementation <br /> <br /> <br />MM HAZ-1.2: The project applicant shall complete a Cap <br />Construction Completion Report documenting the <br />construction sequence that was followed to construct a cap <br />over the soil. The Cap Construction Completion Report shall <br />document that the cap was constructed in general <br />conformance to Toxic Substances Control Act (TSCA) <br />requirements set forth in the Site Cleanup Plan, 40 CFR <br />761.61(a)(7), and 40 CFR 264.310(a), and will include <br />drawings showing the cap thickness across the site. The Cap <br />Construction Completion Report shall be submitted to the <br />RWQCB and Director of Community Development & <br />Transportation for review and approval prior to the issuance <br />of Occupancy Permits. <br /> <br />MM HAZ-1.3: The project applicant shall prepare a Cap <br />Maintenance Plan to ensure the cap integrity is maintained <br />throughout the life of the development. The plan shall <br />include annual cap inspections to be performed by an <br />individual approved by the RWQCB. Cap inspections shall <br />consist of walking the site and evaluating surface material <br />above the cap. Surface material shall be visually inspected <br />for the following: <br /> <br />• Erosion of surface features and cap soil that exposes <br />existing soil beneath the cap <br />• Evidence of excavation or other surface disturbance <br />which may penetrate through the cap and expose <br />existing soil beneath the cap. <br /> <br /> <br />Prior to the issuance of <br />Occupancy Permits <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br />The cap integrity shall be <br />maintained throughout the <br />life of the development and <br />annual cap inspections shall <br />be completed. Any <br />significant disturbances <br />observed in the surface <br />material and soft TSCA cap <br />which could potentially <br />result in a breach to the cap <br />exposing existing underlying <br />soil shall be repaired within <br />72 hours of discovery.
