<br />ATTY/RESO.0041/PC RESO AMENDING ZONING ORDINANCE – AFFORDABLE HOUSING <br />REV: 05-30-23 SK <br />Page 12 of 25 <br />8. Vested Right to Proceed. Residential or nonresidential development projects to <br />the extent they have received a vested right to proceed without payment of <br />housing impact fees pursuant to state law, including those that are the subject <br />of development agreements currently in effect with the City, if such development <br />agreements were approved prior to the effective date of the oOrdinance from <br />which this Article is derived and where such agreements expressly preclude the <br />City from requiring payment of the housing impact fee. <br /> <br />9. Provision of Affordable Housing. A residential or nonresidential development <br />project may mitigate its impact on the need for affordable housing by providing <br />affordable housing units instead of paying the impact fee, so long as the <br />affordable units are provided in accordance with an affordable housing plan <br />(Section 29.7) and meet all of the standards in Section 29.6 and 29.8.A and the <br />Ddeveloper provides reasonable assurances required by the City that the <br />affordable units will be timely completed. <br /> <br />10. The following specific nonresidential uses are exempt from the payment of the <br />housing impact fee: <br /> <br />a. Public Uses, as defined by Article 2, Section 2.2 of the Redwood City Zoning <br />Code, including, but not limited to, public schools, parks, playgrounds, <br />hospitals, and administrative and service facilities; <br /> <br />b. Quasi-Public Uses, as defined by Article 2, Section 2.2 of the Redwood City <br />Zoning Code, including, but not limited to, houses of worship, schools and <br />colleges, recreational facilities, cultural institutions and private hospitals; <br /> <br />c. Child Care Centers, including Family Child Care Homes; <br /> <br />d. Recreational facilities for public use and enjoyment within commercial or <br />industrial developments; <br /> <br />e. Housing for the Elderly, nursing homes, rest homes, residential care <br />facilities, and skilled nursing facilities as defined by Article 2, Section 2.2 of <br />the Redwood City Zoning Code; <br /> <br />f. Schools, public and private, as defined by Article 2, Section 2.2 of the <br />Redwood City Zoning Code; and <br />g. Property eligible for the California Property Tax Welfare Exemption in that it <br />is (1) used exclusively for charitable purposes, and (2) owned or held in trust <br />by nonprofit organizations operating for those purposes and that have a <br />current tax exempt letter from the Internal Revenue Service or the Franchise <br />Tax Board. <br /> <br />11. Any other uses that may be specified by resolution of the City Council. <br />
