<br />Nothing in this Agreement shall preclude San Francisco from selling water to any county, <br />city, town, political subdivision or other public agency for resale to Stanford or to customers <br />within the service area of Stanford. <br /> <br />B. Notwithstanding anything in Section 8.08 to the contrary, Stanford shall have the <br />right to assign to a public agency having the power of eminent domain all or a portion of the <br />rights of Stanford under this Agreement or the Individual Water Sales Contract between it and <br />San Francisco in connection with the acquisition by such public agency of all or a portion of <br />Stanford's water system. In the event of any such assignment of all the rights, privileges, and <br />obligations of Stanford under such contract, Stanford shall be relieved of all further obligations <br />under such contract, provided that the assignee public agency expressly assumes Stanford's <br />obligations thereunder. In the event of such an assignment of a portion of the rights, privileges, <br />and obligations of Stanford under such contract, Stanford shall be relieved of such obligations <br />so assigned thereunder, provided that the assignee public agency shall expressly assume such <br />obligations so assigned to it. <br /> <br />Nothing in this Agreement shall require or contemplate any delivery of water to Stanford <br />in violation of the Act. <br /> <br />9.06 City of San Jose and City of Santa Clara <br /> <br />A. Continued Supply on Temporary, Interruptible Basis. During the.term of the <br />1984 Agreement, San Francisco provided water to the City of San Jose ("San Jose") and the <br />City of Santa Clara ("Santa Clara") on a temporary, interruptible basis pursuant to SFPUC <br />Resolution No. 85-0256. Subject to termination or reduction of supply as provided in Section <br />4.05 of-this Agreement, San Francisco will continue to supply water to San Jose and Santa <br />Clara on a temporary, interruptible basis pending a decision by the Commission, pursuant to <br />Section 4.05.H, as to whether to make San Jose and Santa Clara permanent customers of the <br />Regional Water System. San Francisco will furnish water to San Jose and Santa Clara at the <br />same rates as those applicable to other Wholesale Customers pursuant to this Agreement. <br />Water delivered to San Jose and Santa Clara after July 1, 2009 may be limited by the SFPUC's <br />ability to meet the full needs of all its other Retail and Wholesale Customers. The service areas <br />of San Jose and Santa Clara set forth in their Individual Water Sales Contracts may not be <br />expanded using the procedure set forth in Section 3.03. The combined annual average water <br />usage of San Jose and Santa Clara shall not exceed 9 MGD. The allocation of that total <br /> <br />-88- <br /> <br />1840795.8 <br />
