San Francisco will use its best efforts to meet the seismic reliability and <br />delivery reliability Level of Service Goals and Objectives adopted by the Commission in <br />conjunction with the WSIP. San Francisco will distribute water on an equitable basis throughout <br />the Regional Water System service area following a regional Emergency, subject to physical <br />limitations caused by damage to the Regional Water System. <br />3. San Francisco's response to Emergencies will be guided by the then- <br />current version of the ERRP. The SFPUC shall periodically review, and the Commission may <br />amend, the ERRP to ensure that it remains an up-to-date and effective management tool. <br />4. The SFPUC will give the Wholesale Customers notice of any proposal to <br />amend the ERRP in a manner that would affect them. The notice will be delivered at least thirty <br />days in advance of the date on which the proposal is to be considered by the Commission and <br />will be accompanied by the text of the proposed amendment. <br />C. Shortages Caused by Drought; Acquisition of Dry Year Supplies. <br />Notwithstanding San Francisco's obligations to deliver the Supply Assurance to the <br />Wholesale Customers collectively and the Individual Supply Guarantees to Wholesale <br />Customers individually, San Francisco may reduce the amount of water available to the <br />Wholesale Customers in response to Drought. <br />1. The Tier 1 Shortage Plan (Attachment H) will continue to be used to <br />allocate water from the Regional Water System between Retail and Wholesale Customers <br />during system-wide shortages of 20% or less. <br />2. San Francisco and the Wholesale Customers may negotiate in good faith <br />revisions to the Tier 1 Shortage Plan to adjust for and accommodate anticipated changes due to <br />demand hardening in the SFPUC's Wholesale and Retail Service Areas. Until agreement is <br />reached, the current Tier 1 Shortage Plan will remain in effect. <br />3. The SFPUC will honor allocations of water among the Wholesale <br />Customers (“Tier 2 Allocations”) provided by BAWSCA or if unanimously agreed to by all <br />Wholesale Customers. If BAWSCA or all Wholesale Customers do not provide the SFPUC with <br />Tier 2 Allocations, then the SFPUC may make a final allocation decision after first meeting and <br />discussing allocations with BAWSCA and the Wholesale Customers. For Regional W ater <br />System shortages in excess of 20%, San Francisco shall (a) follow the Tier 1 Shortage Plan <br />allocations up to the 20% reduction, (b) meet and discuss how to implement incremental
