34 <br />2021 Amended and Restated WSA 17162043.1 <br />Article 4. Implementation of Interim Supply Limitation. <br />4.01. Interim Supply Limitation Imposed by SFPUC <br />In adopting the WSIP in Res. No. 08-0200, the Commission included full implementation of all <br />proposed WSIP capital improvement projects to achieve Level of Service Goals and Objectives <br />relating to public health, seismic safety, and delivery reliability, but decided to adopt a water <br />supply element that includes the Interim Supply Limitation. This article describes how the <br />parties will implement the Interim Supply Limitation imposed by the SFPUC between the <br />Effective Date and December 31, 2018, and how the SFPUC will conduct water supply planning <br />after December 31, 2018. <br />4.02. Retail and Wholesale Customer Allocations Under Interim Supply Limitation <br />The Interim Supply Limitation is allocated as follows between Retail and Wholesale <br />Customers: <br />Retail Customers' allocation: 81 MGD <br />Wholesale Customers' allocation: 184 MGD <br />The Wholesale Customers' collective allocation of 184 MGD under the Interim Supply <br />Limitation includes the demand of the cities of San Jose and Santa Clara, whose demand is not <br />included in the Supply Assurance, as provided in Section 3.02.B. By December 31st, 2010, the <br />Commission will establish each Wholesale Customer's Interim Supply Allocation at a public <br />meeting. <br />4.03. Transfers of Interim Supply Allocations <br />A.Any Wholesale Customer, including Hayward, may transfer a portion of its <br />Interim Supply Allocation to one or more other Wholesale Customers, as provided in this <br />section. All Wholesale Customers are also eligible transferees, including California Water <br />Service Company up to its Individual Supply Guarantee. <br />B.Transfers of a portion of an Interim Supply Allocation must be prospective. The <br />duration of a transfer cannot be less than the balance of the fiscal year. The minimum quantity <br />that may be transferred is 1/10th of a MGD. <br />C.Transfers of portions of Interim Supply Allocations are subject to approval by the <br />SFPUC.
