<br />19398850.6 <br />ATTACHMENT E -1 <br /> <br />TEMPORARY MODIFIED MINIMUM ANNUAL PURCHASE QUANTITIES <br /> <br />(Sections 3.04 and 3.07.C) <br /> <br />AGENCY <br />TEMPORARY MODIFIED MINIMUM <br />ANNUAL PURCHASE QUANTIT Y <br />(IN MGD) <br />EFFECTIVE FISCAL <br />YEAR OF TEMPORARY <br />MODIFIED MINIMUM <br />ANNUAL PURCHASE <br />QUANTITY <br /> <br />City of East Palo Alto <br /> <br />2.09 1 2022-23 <br /> <br /> <br />1 This Temporary Modified Minimum Annual Purchase Quantity is the result of the Minimum <br />Water Purchase Transfer Agreement between the City of Mountain View and the City of East <br />Palo Alto, effective February 28, 2023, pursuant to which the City of Mountain View may <br />transfer up to 1.0 MGD of its Minimum Annual Purchase Quantity to the City of East Palo Alto, <br />in 0.25 MGD increments according to a specified procedure that does not conform to Sections <br />3.04 and 3.07.C of this Agreement. For each incremental transfer, Mountain View will maintain, <br />and be responsible for paying any Imputed Sales for, its current Minimum Annual Purchase <br />Quantity, as set forth in Attachment E, including up to 1.0 MGD of its Minimum Annual Purchase <br />Quantity transferred to East Palo Alto, until East Palo Alto's metered water purchases from San <br />Francisco meet or exceed its Temporary Modified Minimum Annual Purchase Quantity for three <br />consecutive fiscal years. East Palo Alto will not be required to pay Imputed Sales associated <br />with its Temporary Modified Minimum Annual Purchase Quantity for any incremental transfer of <br />the 1.0 MGD of Mountain View's Minimum Annual Purchase Quantity. This Temporary Modified <br />Minimum Annual Purchase Quantity in the amount of 2.09 MGD reflects the first incremental <br />transfer of 0.25 MGD of Mountain View’s Minimum Annual Purchase Quantity to East Palo Alto. <br />Once East Palo Alto's metered water purchases from San Francisco meet or exceed 2.09 MGD <br />for three consecutive fiscal years, Mountain View’s Minimum Annual Purchase Quantity will be <br />reduced by 0.25 MGD and East Palo Alto will receive and will be responsible for paying any <br />Imputed Sales for a Minimum Annual Purchase Quantity in the amount of 0.25 MGD, in <br />accordance with the terms and conditions of the Minimum Water Purchase Transfer Agreement.
