A deed restriction shall be recorded against the property to ensure the <br />long term use of the portion of the development for child care. <br />b. Mezzanine floor area. Mezzanine floor area that overhangs less than twenty- <br />five (25) percent of the ground floor area shall be exempt from the computation <br />of FAR. <br />c. Parking. Garages, carports, and parking structures, including underground <br />parking areas that are located below finished grade or finished floor of habitable <br />space. <br />2. Incentive-Based FAR Bonus. A bonus FAR of up to 0.2 (but not to exceed a total FAR of <br />1.0, not including exceptions as applicable in Section 12.3(B)(1) above) may be <br />permitted for projects that provide public or quasi-public open space, provided that all <br />of the following conditions are met: <br />a. Provide Quasi-Public or Public open space amounting to at least 0.25 acres or <br />ten (10) percent of the project area, whichever is greater, shall be provided. <br />b. Quasi-Public or Public open space shall include enhancements to support its <br />use, such as benches, trails, and landscaping. <br />c. Public or quasi-public open space shall be bordered on at least one (1) side by <br />a public street and shall be shall be accessible and fully visible from that street. <br />d. Signage and appropriate public access to the usable open space shall be <br />provided to clearly indicate that the space is available for public use. <br />e. Public and quasi-public open space Public and quasi-public open space shall be <br />located in front of buildings, and shall not be located where views of the quasi- <br />public space from the public right-of-way would be obstructed by buildings or <br />other structures. <br />f. A public access easement shall be recorded against the property that ensures <br />public access to the portion of the project which qualify it for the FAR Bonus. <br />C. Outdoor Equipment and Facilities. <br />1. Trash and refuse collection and disposal facilities, and recycling facilities shall be <br />enclosed by a solid fence and screened with permanently maintained landscaping. <br />2. Outdoor generators and equipment tanks shall be screen from public view by a <br />structure or landscaping, shall meet all applicable safety standards, and shall not be <br />located within a required parking stall. <br /> <br />12.4 Minimum Pervious Area and Stormwater Regulations. <br />A minimum of twenty (20) percent of each lot shall be pervious area, to be composed of <br />landscaping, vegetated open space, or permeable paving materials, consistent with the <br />provisions of Section 32.12 of the Zoning Ordinance, as that section may be amended from time <br />to time. All development is also subject to the requirements of Chapter 27A (Stormwater <br />Treatment Measures and Maintenance Program) of the Municipal Code, as that chapter may be <br />amended from time to time. <br /> <br />12.5 Parking Location and Design Regulations.
