The Transit District is an overlay (sub -area) within the DTPP focused on transit - <br />oriented development. Unless otherwise expressly provided in the DTPP eeted, <br />all DTPP policies contained within Section 2, including development regulations as <br />defined in Section 2.0.1(g) above, shall apply to the all property within the <br />DTPP (including Transit District). <br />Sec. 2.0.3 - HOW TO OBTAIN PROJECT APPROVAL <br />2. Large Projects <br />Large Projects are projects in which no historic resource is located on the project parcel <br />and in which one of the following descriptions applies: 1) The application is for the <br />remodeling of an existing building in which more than 10% new floor area is added, and <br />in which the site is more than 30,000 square feet in size; 2) The application is for new <br />development in which the site is more than 30,000 square feet in size; 3) The application <br />involves an exposed parking structure (see Section 2.6); or 4) The application involves <br />new building construction or building additions exceeding 35 ft. or three stories in height <br />(unless otherwise noted below), unless the addition is minor, as determined by the <br />Community Development Director or his/her Designee. <br />a. Project Approval Authority. <br />I. The City Council (with recommendation by the Planning Commission) <br />shall be the Approval Authority for Large Projects that (a) are located <br />within the Transit District, and/orb any project within the DTPP which <br />will required ,e General Plan Amendments and/or a DTPP Amendment. <br />shall betheCity GeunGil with reGOFnr rendatien by tiby Planning <br />Gemm;ss;^n The decision of the City Council shall be final. <br />11. The Approval Authority for all other Large Projects shall be the Planning <br />Commission. The decision of the Planning Commission shall be final <br />unless appealed or called up to the City Council (Article 41.4.0 of the <br />Zoning Code). <br />III. Project Approval. The Approval Authority shall evaluate Large <br />Projects based on the applicable DTPP Standards and Guidelines. The <br />Approval Authority shall hold at least one Public Hearing on the <br />application. Legal notice of the Public Hearing shall be given as <br />provided in Article 49 of the Zoning Ordinance. <br />1. Standards and Guidelines Compliance. The Planning <br />Manager/Designee shall review the project application for <br />conformance to the DTPP and the applicable Standards and <br />Guidelines and shall make a recommendation on the Project to <br />the Approval Authority. The Approval Authority shall evaluate <br />the staff recommendation as well as any other information <br />presented at the Public Hearing -in making a decision on the <br />project. <br />2. Standards Compliance Only. For projects which the Planning <br />Manager/Designee deems to conform to the Standards, but not <br />the guidelines, he/she shall seek a recommendation from the <br />Architectural Advisory Committee (AAC) or successor <br />committee on the acceptability of the aspects of the project <br />which do not conform to the Guidelines.
