REV: 08-25-23 VR <br />o Nexus studies will be posted for public review in November <br />o Council will consider updated fees in December <br />o <br />Task 4 Budget <br />The Task 4 budget is $6,000 for both events. The first event (regardless of format) is <br />$4,000 (approx. 10 hrs) and includes preparation of the presentation materials. The <br />second event assumes use of the same (or very slightly modified) presentation materials <br />at a cost of $2,000 (approx. 5 hrs). <br />Phase II: Annual and Five-Year Report (September, October and November 2023 <br />and/or concurrent with any fees being updated at this time) <br />The Mitigation Fee Act (Gov. Code 66000 et. seq.) specifies the timing, frequency, public <br />noticing, and content of the required Annual and Five-Year Reports. This phase of work <br />will respond to the legal requirements of the Mitigation Fee Act and respond to emerging <br />best practices related to pending legal cases. This work is dependent on the Phase I <br />financial audit, as the tracking of revenues and expenditures will come from the audit. <br />Deliverables: A model AB 1600 report with instructions to staff that can be used in <br />this and future years, and guidelines on best practices for fee adoption, <br />implementation, accounting and expenditures, and 2022/2023 Annual and Five- <br />Year Report, including Tables. <br />Meetings: Up to four (4) meetings with the Finance Department (or financial/accounting <br />expert) to discuss fee program revenues and expenditures. Weekly check-ins with City <br />staff and legal counsel (up to 8). <br />Fees <br />Consultant shall be compensated for Services provided on an hourly basis at the rates <br />identified below and for a not-to-exceed amount as provided below: <br />Phase I Total: $60,500 <br />Task 1: $20,000 (already authorized in Original Agreement, fee does not include <br />budget for the finance/accounting professional(s) <br />Task 2: $24,500 (includes contingency) <br />Task 3: $10,000 <br />Task 4: $6,000 <br />Phase II Total: $25,000 (already authorized in Original Agreement) <br />Phase I and II Total: $85,500 ($45,000 already authorized, and $40,500 is requested as <br />part of Amendment #1) <br />ATTY/AGR.2023/Amend.
