REV: 11-22-23 MI <br />Develop conclusions, recommendations, and produce reports, as necessary to <br />maintain regulatory compliance for each financing. <br />Provide analytical reports with recommendations for actions necessary to close <br />the gap between adequate rebate reporting and comprehensive bonded debt <br />compliance management. <br />Our reports and recommendations will include, but will not be limited to: <br />o Actions that can be taken to increase monies available for the project; <br />o Actions that can be taken to decrease an arbitrage rebate liability or <br />upcoming yield reduction payment; <br />o Actions that can be taken to correct situations that may receive an <br />unfavorable audit determination; <br />o Areas where allocation and accounting methodology could be <br />enhanced; <br />o Identification of technologies not currently in use that may be applicable <br />and appropriate for future consideration; <br />o Identification of obstacles or challenges that could prevent timely or <br />accurate compliance; <br />o Detailed arbitrage rebate report inclusive of summary analysis; and <br />o Instructions for filing IRS forms. <br />Hardcopy and electronic reports inclusive of: <br />o Executive Summary detailing the assumptions and methodology used; <br />o Summary Analysis of all relevant dates; <br />o Sources and uses of funds; <br />o Arbitrage yield and yield restriction requirements; <br />o Rebate liability summarized and by fund; <br />o Arbitrage/Investment Yield Comparison Graph; <br />o Rebate Calculations by fund; and <br />o Outstanding Investments Summary. <br />5. Review Results with City Staff <br />Ensure City staff has adequate understanding of the rebate positions, <br />opportunities, and possible areas of enforcement concern. <br />The Consultant team will brief City staff on situations that offer opportunity for <br />improved results or that may become a concern for regulatory auditors. <br />Key strategic, procedural and investment issues will be discussed, as well as <br />City strengths and challenges relating to long-term debt compliance. <br />One (1) week. <br />ATTY/AGR.2023.232/Willdan Financial Services (Willdan Financial Services) (Page 19 of 22)
