REV: 11-07-23 SK <br />Consultant will prepare and submit the Basis of Design Report (BOD) to the <br />City. <br /> City will review the submittal and issue comments and markups. <br />Consultant will prepare a comment checklist that includes preliminary <br />responses and proposed revisions to address each comment. <br />Consultant will schedule and conduct a City Meeting, as described and <br />budgeted under Task 1. <br />City staff will review the comment checklist and confirm proposed revisions <br />are acceptable. <br />Consultant will revise and resubmit the BOD to the City. <br />Deliverables for task 4: Pump Station Layout Alternatives (PDF), Vehicle Access Exhibits <br />(PDF), Surge Analysis Memorandum (PDF), Noise Analysis Memorandum (PDF), and <br />Basis of Design Report - BOD (PDF). <br />TASK 5: ENVIRONMENTAL AND PERMITTING <br />Subtask 5.1 – Permit Technical Memorandum <br />Consultant’s environmental and CEQA subconsultant, MIG, will investigate <br />whether the project could be approved with a Categorical Exemption (CE) <br />under Section 15301(b) Existing Facilities, or Section 15302(c) Replacement <br />or Reconstruction, of the CEQA Guidelines. If it is determined that the project <br />could potentially qualify under either of these categories, Consultant will <br />determine whether the project would trigger any of the exceptions to the use of <br />a CE, as specified in (Section 15300.2) of the Guidelines. If any of the exception <br />criteria would be applicable, then the project would not qualify for a CE. <br />If the project was not found to be eligible to use a CE to provide the <br />necessary CEQA clearance, MIG will review the applicable provisions of the <br />CEQA Guidelines for preparation of an Initial Study/Mitigated Negative <br />Declaration (IS/MND) and verify that one of these two types of documents <br />would be required. Consultant and subconsultant will prepare a technical <br />memorandum for City review that documents their research and findings, <br />based on the project plans provided and their knowledge of the CEQA <br />Guidelines, and presents clear findings of the project’s eligibility for either a CE <br />or an Initial Study/ND/MND and includes their recommendations for selection <br />of the proper document. In addition, the memorandum will include an <br />assessment of any required regulatory agency permits, their application <br />procedures and estimated processing times, and mitigation requirements. It is <br />anticipated that the agencies involved will be California Department of Fish and <br />Wildlife, SF Bay Regional Water Quality Control Board, and U.S. Army Corps <br />of Engineers. The subconsultant, MIG, is prepared to prepare the required <br />CEQA documentation, described above, as well as assist the City with agency <br />permitting, as an additional service once the specific requirements are <br />ATTY/AGR.2023.241/BKF Engineers (Price Tract Pump Station Design) (Page 21 of 54)
