REV: 11-07-23 SK <br />general area having conducted a number of archaeological projects over <br />the past 30 years. Based on its knowledge of the area, it is anticipated <br />that the research will support a Finding of No Effect (FOE) as Consultant <br />is not aware of any recorded cultural resources and/or tribal resource <br />within or adjacent to the project site. The results will be prepared in a <br />focused HPSR/FOE that will provide: (1) a description of the project and <br />proposed improvements; (2) information from the records search as well <br />as review of archival records on file with BASIN; (3) results of Native <br />American outreach; (4) results of a field inventory; (5) findings; and, (6) <br />an assessment of the project’s potential effect on any cultural properties <br />and recommendations. Appropriate graphics will be appended. The <br />focused HPSR/FOE will not include summary context statements on the <br />prehistory and history unless the research determines that these may <br />be helpful in developing potential effects. BASIN anticipates one round <br />of review. <br />Schedule. The HPSR/FOE may require 8-12+ weeks to complete <br />from a Notice to Proceed. The NAHC usually responds to an SLF inquiry <br />within 4-6 weeks and an additional 2-3 weeks are required for responses <br />from an individual tribes and Native Americans. BASIN estimates that a <br />regular search from the CHRIS/NWIC may require 4+ weeks due to their <br />reduced schedule. The proposed schedule anticipates that the <br />proponent can provide access to the project site for review, a detailed <br />project description, electronic copies of maps and figures that can be <br />used to complete the report and used to illustrate potential project <br />impacts. copies of maps and figures that can be used to complete the <br />Memo and used to illustrate potential project impacts. Task Deliverable: <br />Focused HPSR/FOE. <br />Resource Agency Permits: The project is located on Redwood Creek near <br />its confluence with San Francisco Bay, where the creek is tidally influenced. <br />Portions of the project that require discharge into the creek (such as a new <br />outfall) may be subject to permits from the U.S. Army Corps of Engineers <br />(USACE; in consultation with NOAA Marine Fisheries Service), the Regional <br />Water Quality Control Board (RWQCB), and the Bay Conservation and <br />Development Commission (BCDC). Because it is in tidal waters it does not <br />require a permit from the California Department of Fish and Wildlife. MIG will <br />request copies of permits for the existing pump station outfall from the <br />Consultant and/or the City. Consultant will assume that the project does not <br />require any authorization from the State Lands Commission. MIG will make a <br />preliminary determination of agency jurisdiction when preparing the biological <br />resources report, and Consultant will confer with Consultant’s engineers during <br />project design to identify possible ways to avoid or minimize the number of <br />permits required and the amount of mitigation, if any is expected to be required <br />by the agencies. The first step with the agencies is usually to request an <br />Interagency Meeting with the USACE, RWQCB, and BCDC to verify which <br />permits are required for the project.
