<br />REV: 11-07-23 SK <br />meeting held at the USACE offices in San Francisco where it is possible to <br />have an informal consultation with the agencies regarding the proposed project. <br />Consultant must provide information about the project to the agencies in <br />advance, and it is best to have either the 30% design phase or a well-described <br />concept ready so that the agencies have something to comment on. The project <br />may be straightforward enough that an Inter-agency Meeting is not necessary, <br />but we have included it in the budget. Consultant is required to request a pre- <br />filing meeting with the RWQCB 30 days before submitting an application to the <br />USACE. This allows the RWQCB adequate time to review the project because <br />once an application is submitted to the USACE, the USACE requires action <br />from the RWQCB within a certain time frame. If a pre-filing meeting is not <br />requested the RWQCB will deny the project. The scope of work includes time <br />for the pre-filing meeting. This proposal assumes that the project would require <br />a Clean Water Act Section (CWA) Section 404 permit from the USACE, and a <br />CWA Section 401 Water Quality Certification. Depending on whether the <br />USACE takes jurisdiction, the project may only require Porter-Cologne Water <br />Quality Control Act (Porter-Cologne) Waste Discharge Requirements (WDRs) <br />from the RWQCB, and a permit from the BCDC. The CWA Section 404 permit <br />would require a preliminary jurisdictional delineation (JD) of wetlands and other <br />waters in the project area and may require a Biological Assessment for <br />compliance with Section 7 of the Federal Endangered Species Act (FESA), <br />and/or a Cultural Resources Investigation (CRI) for compliance with Section <br />106 of the National Historic Preservation Act (NHPA). The scope of work <br />includes preparation of a biological resources report, but the federal Biological <br />Assessment is a different document that would focus on federally listed species <br />(expected to only be fish at this time), and it has a different format. Consultant <br />would use the biological resources report to the extent we can, then add the <br />necessary sections for a Biological Assessment. Consultant has included an <br />additional fee of $6,500 in the budget for preparation of the Biological <br />Assessment. Once the permit applications are submitted, MIG will help the <br />City/Consultant follow up with the agencies and respond to any questions they <br />may have. <br />OPTIONAL TASK 11: ENVIRONMENTAL SITE ASSESSMENTS <br />• Phase I ESA. As an optional task, the Consultant Team will provide a Phase <br />I environmental assessment of the subject property and a preliminary <br />evaluation of the environmental conditions at the subject site in accordance <br />with ASTM E1527-21 (Standard Practice for Environmental Site Assessments: <br />Phase I Environmental Site Assessment Process). For this task, the <br />subconsultant, BAGG will review and research the most recently updated <br />Federal and State agency databases regarding known or documented cases <br />of contamination that may exist on-site or within a 1-mile radius of the subject <br />site. The databases that will be searched electronically will be based on the <br />ASTM E 1527-21 guidelines. EDR (Environmental Data Resources) will be <br />retained to perform this service.
