RECORDING REQUESTED BY <br />CITY OF REDWOOD CITY <br />AND WHEN RECORDED MAIL, TO: <br />City of Redwood City <br />1017 Middlefield Road <br />Redwood City, CA 94063 <br />Attention: City Clerk <br />NO FEE FOR RECORDING PURSUANT <br />TO GOVERNMENT CODE <br />SECTIONS 6103 AND 27383 <br />APN No. <br />(Space above for Recorder's Use) <br />RELEASE OF HOUSING AFFORDABILITY AGREEMENT <br />This Release of Housing Affordability Agreement (the "Release") is made as of the _ <br />day of , 20_, by and between the City of Redwood City, a California charter <br />city (the "City"), SI XX, LLC, a California limited liability company ("Developer") and SI 78, <br />LLC, a California limited liability company (the "Affordable Developer"), with reference to the <br />following facts (the City, Developer, and Affordable Developer may be referred to collectively <br />as the "Parties"): <br />The Parties entered into that certain Housing Affordability Agreement dated <br />2023 (the "Housing Agreement"), and recorded in the Official Records of San Mateo County <br />(the "Official Records") on as Document No. , against <br />that real property located in Redwood City, California (the "Broadway Plaza Residential Site"). <br />The Broadway Plaza Residential Site is defined as the "Residential Site" in the Housing <br />Agreement. <br />The Developer and, if applicable, Affordable Developer have performed their respective <br />obligations as required by Section 2.7(b) of the Housing Agreement in connection with the <br />construction of Building Three. <br />The property described in the attached Exhibit A shall be referred to as the "Released Property". <br />The Parties now desire to release the encumbrance of the Housing Agreement on the Released <br />Property. <br />All terms not otherwise defined herein shall have the meaning set forth in the Housing <br />Affordability Agreement. <br />2 <br />1199\10\3609857.1 <br />REV: 10-18-23 SK <br />
