Developer has submitted the Parcel Map and applied to City for Parcel Map <br />approval without having completed the required public improvements and, therefore, will <br />enter into an agreement with City providing for the future construction and installation of <br />such public improvements, as required by Government Code section 66411.1. <br />E. Developer has submitted to City plans, specifications and drawings entitled <br />Off -Site Improvement Plans of 1401 Broadway, prepared by Kier & Wright and dated <br />, 20_, Off -Site Utility Improvement Plans of 1401 Broadway, prepared by <br />Kier & Wright and dated September 01, 2020, Recycled Water Plan of 1401 Broadway, <br />prepared by Kier & Wright and dated February 25, 2021, Bay & 5t" Improvement Plans, <br />prepared by Kier & Wright and dated February 3, 2022, Site Improvement Plans of <br />MidPen Broadway Plaza, prepared by Kier & Wright and dated.. , 20_, Site <br />Improvement Plans of Broadway Plaza — Office, prepared by Kier & Wright and dated <br />20_, and Site Improvement Plans of Sobrato Broadway Plaza <br />Residential, prepared by Kier & Wright and dated , 20_(the "Improvement <br />Plans"), which, in addition to other improvements, provide for certain on-site and off-site <br />public improvements consisting of street, sidewalk, driveway, street trees, and street light <br />improvements, storm drain collection, detention, and treatment systems, domestic water <br />systems, recycled water systems, and sanitary sewer systems for the Project (collectively, <br />"Improvements"). <br />F. Upon approval and recordation of the Parcel Map, the Broadway Block will <br />be divided into one common lot parcel for commercial condominium purposes and two <br />residential air parcels. <br />G. City and Developer desire to enter into this agreement providing for the <br />construction and installation of the Improvements in accordance with the Improvement <br />Plans. <br />AGREEMENT <br />NOW, THEREFORE, in consideration of the faithful performance of the terms and <br />conditions set forth in this Agreement, the Parties hereto agree as follows: <br />1. Purpose. The purpose of this Agreement is to guarantee completion of the <br />Improvements and ensure satisfactory performance by Developer of Developer's <br />obligations to satisfy the Conditions pertaining to the Improvements. <br />2.
