<br />REPORT <br /> <br />6.1H <br />Page 1 <br /> <br /> <br />November 9, 2009 <br /> <br />SUBJECT <br />Award of Contract - Redwood Shores. Levee Improvement Project <br /> <br />RECOMMENDATION <br />By motion, approve the contract documents and award the contract for the Redwood <br />Shores Levee Improvement Project to CEM Builders, Inc. DBA Tucker Engineering of <br />Los Gatos for their responsive and responsible low bid of $661,866.35 and authorize <br />the City Manager to increase the contract amount up to 1 Oo~ if necessary, and reject the <br />bid protest submitted on November 3, 2009 by GradeTech, Inc. for the reasons <br />contained in this report. <br /> <br />BACKGROUND <br />The Federal Emergency Management Agency (FEMA) is implementing a Flood Map <br />Modernization (Map Mod) program to convert paper Flood Insurance Rate Maps <br />(FIRMs) to digital. As part of Map Mod, FEMA mandates the inclusion of levee <br />evaluations for those communities undergoing map changes. <br /> <br />The Redwood Shores Levee Improvement Project is in response to FEMA's levee <br />certification mandate. The city is undertaking this levee improvement project to raise <br />the height of the levees in the Redwood Shores area and complete certification prior to <br />September 2010, the effective date of the new FIRMs. <br /> <br />The project involves grading and earthwork to raise the levee height of approximately' <br />17,300 feet of levee surrounding the Redwood Shores to meet FEMA's standard. <br /> <br />Eight (8) bids were received at the bid opening on Monday, November 2, 2009 for the <br />"Redwood Shores Levee Improvement Project" and are summarized in the table below. <br /> <br />Bidder Bid Amount <br />CEM Builders Inc., DBA Tucker Enaineerina - Los Gatos $ 661,866.35 <br />GradeTech, Inc. - San Ramon 978,302.60 <br />Granite Rock Company DBA Pavex Construction Division - San Jose 1,022,505.80 <br />DeSilva Gates Construction, L.P. - Dublin 1,074,921.00 <br />Rodan Builders, Inc. - Burlinaame 1,095,549.00 <br />Interstate Grading & Paving, Inc. - So. San Francisco 1,193,461.20 <br />Granite Construction Company - Watsonville 1,474,810.00 <br />Wood Bros., Inc. - Lemoore 1,533,976.98 <br />Engineer's Estimate $ 938,000.00 <br />Recommended Bidder: CEM Builders Inc., DBA Tucker Engineering of Los <br />Gatos, CA <br />Substantiation: CEM Builders Inc., DBA Tucker Engineering of Los Gatos, <br />CA is the lowest reSpOnsive and resoonsible bidder. <br /> <br />The low bid of $661,866.35 submitted by CEM Builders, Inc. DBA Tucker Engineering is <br />41 % lower than the engineer's estimate of $938,000.00. Staff attributes this variance to <br />a very competitive bidding market.
