<br />REPORT <br /> <br />6.28 <br />Page 1 <br /> <br />To the Honorable Mayor and City Council <br />From the Ci Mana er <br /> <br />November 9, 2009 <br /> <br />SUBJECT <br />Maintenance Agreements and Public Service Easement Dedication for the newly <br />constructed Redwood Shores school at 225 Shearwater Parkway <br /> <br />ReCOMMENDATION <br />1. By motion, approve and authorize the City Manager to execute a Stormwater <br />Treatment Measures Maintenance Agreement and a Landscape Maintenance <br />Agreement with the Belmont Redwood Shores School District. <br /> <br />2. By resolution, approve and authorize the City Manager to accept the dedication of <br />Public Service Easements from the Belmont Redwood Shores School District. <br /> <br />BACKGROUND <br />The Belmont Redwood Shores School District (District) has constructed a new scllool at <br />225 Shearwater Parkway in Redwood Shores. The new school is located within the <br />Area H parcel subdivided in July, 2008 by Keech Properties, LLC and is expected to <br />open in fall of 2010. Certain improvements have been constructed that must be <br />maintained over a period of time. <br /> <br />The Stormwater Treatment Measures Maintenance Agreement results from a <br />countywide effort known as the Stormwater Pollution Prevention Program (SWPPP). <br />The agreement obligates the developer and subsequent property owners to perform <br />regular maintenance on stormwater treatment installations so those installations <br />continue to function as intended over time. Bioswales and associated drainage inlets are <br />to remain free of debris to best provide proper filtration of stormwater pollutants expected <br />to originate from the school site and parking lot. The agreement satisfies the National <br />Pollution Discharge Elimination System (NPDES) Municipal Stormwater Permit, Order <br />99-059, CAS0029921, which was adopted by the San Francisco Bay Regional Water <br />Quality Control Board in February of 2003. <br /> <br />Separate from the Stormwater Treatment Measures Maintenance Agreement, the District <br />enters into agreement with the City to maintain the landscaping and irrigation installations <br />on Shearwater Drive along the school's frontage and along the levee at the rear of the <br />property. The District will be obligated to maintain the new landscaping in the areas <br />specified. This is consistent with the existing practice as the landscaped frontages along <br />Shearwater Drive are currently maintained by various home owners associations. <br /> <br />Both proposed agreements are available for review in the Office of the City Clerk. <br /> <br />The District dedicates easements to the City at two locations along the new school's <br />frontage where storm drainage dewatering structures have been constructed. <br />Dewatering structures are typical in the Redwood Shores area, acting as the last point <br />of connection to isolate private storm drainage systems from the City's system which <br />discharges into the interior lagoons.
