See Attachment 2 for the Page 2 <br />lease agreement. <br /> <br />Froyola LLC License <br />Froyofa LLC will enter into a license agreement with the City for License Area 2A as <br />shown in the plat map and legal description in Exhibit A of the License Agreement <br />(Attachment 3). The license area, measuring approximately 43' x 36' (1,360 square <br />feet) will have 16 tables and 32 chairs provided by the City for Froyola LLC. use, and <br />shall be avail.able to the public without purchase requirement during Froyola Yogurt's <br />hours of operations. Froyo'a LLC will clean and clear the tables and chairs during <br />hours of operations. The key terms of the license agreement are as follows: <br /> <br />. Month-to-month term <br />. License fee of $.06 per square foot per month for a total of $81.60 per month <br />. Common area maintenance of $600 per month commencing 30 days after all <br />four kiosks are occupied and opened with long-term tenants. <br /> <br />. <br /> <br />The license fee payment of $81.60 will commence on September 1, 2010 which is six <br />months after the projected opening date while the $600 common area maintenance will <br />commence 30 days after all of the kiosks are occupied and operating with long-term <br />tenants. Similar to the rent reduction in the lease agreement, the fees for the license <br />agreement are reduced to ease the tenant's operating costs for the first six months. <br /> <br />ALTERNATIVES <br />The Council and Board may choose not to approve the execution of the Lease and <br />License with Froyola lLC; however another vendor would need to be sought, which <br />would delay occupancy of the Courthouse Square kiosk. <br /> <br />FISCAL IMPACT <br />The lease rent will be $2,406 and license fees are $490 for a total of $2,896 during the <br />first 12 months of operations. Thereafter, the lease rent will be $4,800 and the license <br />rent will be $979 totaling $5,779 annually. Froyola LLC will pay its own utilities. In <br />addition I F royola LLC will pay a common area maintenance fee of $600 per month <br />commencing 30 days after all four kiosks are operating to partially fund the Courthouse <br />Square maintenance.
