<br />6.1E <br />Page 22 <br /> <br />County of San Mateo. <br /> <br />27.15 Accord and Satisfaction. No payment by Lessee or receipt by Lessor of a lesser <br />amount than the rent herein stipulated shall be deemed to be other than on <br />account of the earliest stipulated rent, nor shan any endorsement or statement on <br />any check or any letter accompanying any check or payment as rent be deemed <br />and accord and satisfaction, and lessor may accept such check or payment <br />without prejudice to Lessor's right to recover the balance of such rent or pursue <br />any other remedy in this Agreement provided. <br /> <br />27.16 Permits and Aoorovals. All government permits or approvals are required. <br />Approval by Lessor of any action requiring approval does not constitute approval <br />by the City of Redwood City of any required permits or applications, and in no <br />way limits the discretion of the City in the permit, regulatory, and approval <br />process. Lessor and Lessee will render to each other reasonable assistance in <br />obtaining necessary City and other governmental permits or approvals. <br /> <br />Any consent or approval of the City of Redwood City for any permit, application, <br />or regulatory matter does not constitute consent or approval by the Lessor under <br />the terms of this lease. <br /> <br />28. INSURANCE REQUIREMENTS <br /> <br />28.1 Prior to the commencement of the tenant improvements, the Lessee or its <br />contractor shall furnish the Lessor with copies of the insurance certificates and <br />endorsements for review and approval. <br /> <br />28.2 Prior to the moving of supplies, equipment and products into the Lease area, <br />Lessee shall furnish the adequate insurance in effect. Lessee at its sole cost and <br />expense, shall insure its activities in connection with this Agreement and obtain, <br />keep in force and maintain insurance as follows: <br /> <br />(a) Comprehensive or Commercial Form General Liability Insurance that is at <br />least as broad as the Insurance Service Office (ISO) Form No. CG 00 01 <br />(contractual liability and fire legal liability included) with minimum limits as <br />follows <br /> <br />1. Each Occurrence: One Million Dollars ($1,000,000) <br /> <br />2. Products/Completed Operations and On-going Operations <br />Aggregate: One Million Dollars ($1,000,000) <br /> <br />3. General Aggregate: Two Million Dollars ($2,000,000) <br /> <br />4. Fire Legal Liability to at least One Million Dollars ($1,000,000) <br /> <br />(b) Business Automobile Liability Insurance that is at least as broad as the <br />ISO Form No. CA 00 01 for owned, scheduled, non-owned, or hired <br />automobiles with a combined single limit of not less than One Million <br />Dollars ($1,000,000) per occurrence. <br /> <br />ATTY/AGR/2009.081 <br />110309 <br /> <br />Initials <br /> <br />Page 18 <br />
