City of Redwood City <br />22-PIP-17871 <br />Page 9 of 13 <br />EXHIBIT D <br /> <br />Prohousing Incentive Pilot (PIP) Program <br />NOFA Date: 12/15/2022 <br />Approved Date: 06/12/2023 <br />Preparation Date: 08/24/2023 <br />4) Require the return of unexpended Program funds disbursed under <br />this Agreement; <br /> <br />5) Require repayment of Program funds disbursed and expended <br />under this Agreement; <br /> <br />6) Require the immediate return to the Department of all funds <br />derived from the use of Program funds including, but not limited to <br />recaptured funds and returned funds; <br /> <br />7) Seek, in a court of competent jurisdiction, an order for specific <br />performance of the obligation defaulted upon, or the appointment <br />of a receiver to complete the obligations in accordance with the <br />PIP Program requirements; and <br /> <br />8) Other remedies available at law, or by and through this <br />Agreement. <br /> <br />J. All remedies available to the Department are cumulative and not <br />exclusive. <br /> <br />K. The Department may give written notice to the Grantee to cure the breach <br />or violation within a period of not less than fifteen (15) days. <br /> <br />11. Termination <br /> <br />A. The Department may terminate this Agreement at any time for cause by <br />giving a minimum of thirty days’ notice of termination, in writing, to the <br />Grantee. Cause shall consist of, violations of any terms and/or special <br />conditions of this Agreement, the PIP Statutes, Guidelines or NOFA. Upon <br />termination of this Agreement, unless otherwise approved in writing by the <br />Department, any unexpended funds received by the Grantee shall be <br />returned to the Department within thirty days of the notice of termination. <br /> <br />B. This Agreement is subject to any additional restrictions, limitations or <br />conditions, or statute, regulations or any other laws, whether federal or <br />those of the State of California, or of any agency, department, or any <br />political subdivision of the federal or the State of California governments, <br />which may affect the provisions, terms or funding of this Agreement in any <br />manner. <br />
