The Agency and the receiver shall be liable to account only for those rents actually received. <br />The provisions of this paragraph and Paragraph 22 shall operate subject to the claims of prior lien holders. <br />25. Reconveyance. Upon payment of all sums secured by this Deed of Trust, the Agency will request <br />Trustee to reconvey the Security and will surrender this Deed of Trust and the Note to Trustee. Trustee will <br />reconvey the Security without warranty and without charge to the person or persons legally entitled thereto. Such <br />person or persons will pay all costs of recordation, if any. <br />26. Substitute Trustee. The Agency, at the Agency's option and upon providing written notice to the First <br />Lender, may from time to time remove the Trustee and appoint a successor trustee to any Trustee appointed <br />hereunder. The successor trustee will succeed to all the title, power and duties conferred upon the Trustee herein <br />and by applicable law. <br />27. Superiority ofFirst and Second Lenders Documents. Notwithstanding any provision herein, this Deed <br />of Trust shall not diminish or affect the rights of the First Lender under the First Lender Deed of Trust or any <br />subsequent First Lender Deed of Trust hereafter recorded against the Deed of Trust. <br />28. Use of Property. Borrower shall not permit or suffer the use of any of the Property for any purpose <br />other than as a single family residential dwelling. <br />29. Transfer of the Property-, Assumption. If all or any part of the Property or an interest therein is sold <br />or transferred by Borrower without the Agency's prior written consent, the Agency may, at the Agency's option, <br />declare all the sums secured by this Security Instrument to be immediately due and payable. <br />If the Agency exercises such option to accelerate, the Agency shall mail Borrower notice of acceleration <br />in accordance with Paragraph 22 hereof. Such notice shall provide a period of not less than 30 days from the date <br />the notice is mailed within which Borrower may pay the sums declared due. If Borrower fails to pay such sums <br />prior to the expiration of such period, the Agency may without further notice demand on Borrower, invoke any <br />remedies permitted by Paragraph 22 above hereof. <br />30. Borrower's Copy.
