Construction Services Agreement <br />REV: 04-26-2021 PR <br />00 5205 - 15 <br /> <br /> <br /> <br />Appendix C to Construction Services Agreement <br /> <br />INSURANCE <br />1. Contractor shall maintain commercial general liability insurance with coverage at least as broad as <br />Insurance Services Office form CG 00 01, in an amount not less than two million dollars <br />($2,000,000) per occurrence for bodily injury, personal injury, and property damage, including <br />without limitation, blanket contractual liability and coverage for explosion, collapse and <br />underground property damage hazards. If Contractor’s commercial general liability insurance policy <br />contains a general aggregate limit, then the general aggregate limit shall apply separately to the <br />Project or shall be at least twice the required occurrence limit. Contractor’s general liability policies <br />shall be primary and non-contributory, and be endorsed using Insurance Services Office form CG <br />20 10 to provide that City and its officers, officials, employees, and agents shall be additional <br />insureds under such policies. For construction contracts, an endorsement providing completed <br />operations to the additional insured, ISO form CG 20 37, is also required. <br /> <br />2. Contractor shall provide auto liability coverage for owned, non-owned, and hired autos using ISO <br />Business Auto Coverage form CA 00 01, or “any auto”, or the exact equivalent, with a limit of no <br />less than one million dollars ($1,000,000) per accident. If contractor owns no vehicles, this <br />requirement may be met through a non-owned auto endorsement to the CGL policy. <br /> <br />3. Contractor shall maintain Workers’ Compensation Insurance (Statutory Limits) and Employer’s <br />Liability Insurance with limits of at least one million dollars ($1,000,000). Contractor shall submit to <br />City, along with the certificate of insurance, a Waiver of Subrogation endorsement in favor of City, <br />its officers, agents, employees, and volunteers. <br /> <br />4. If Contractor normally carries insurance in an amount greater than the minimum amounts required <br />by City in Paragraph 1.01 above, that greater amount shall become the minimum required amount <br />of insurance for purposes of the Contract. Therefore, Contractor hereby acknowledges and agrees <br />that all insurance carried by it shall be deemed liability coverage for all actions it performs in <br />connection with the Contract. <br /> The limits of insurance this Contract requires may be satisfied by a combination of primary and <br />umbrella or excess insurance. Any umbrella or excess insurance shall contain or be endorsed to <br />contain a provision that such coverage shall also apply on a primary and non-contributory basis for <br />the City’s benefit, to the extent required by the Contract, before the City’s insurance or self- <br />insurance may be called upon to protect City as a named insured. <br /> <br />5. All policies of insurance shall be placed with insurers acceptable to City. The insurance <br />underwriter(s) for all insurance policies except Workers’ Compensation shall have an A. M. Best <br />Company rating of [A-VII] or better, unless otherwise specified in Contract Documents. Required <br />minimum amounts of insurance may be increased should conditions of Work, in opinion of City, <br />warrant such increase. Contractor shall increase required insurance amounts upon direction by <br />City. <br /> <br />All self-insured retentions (SIR) must be disclosed to the City for approval and shall not reduce the <br />coverage limits. Insurance policies containing an SIR provision shall provide or be endorsed to <br />provide that the SIR may be satisfied by either the named Contractor/named insured or the City. <br /> <br />6. Insurance policies in Appendix C shall contain an endorsement containing the following terms: <br /> <br />6.01 Policies shall be primary and non-contributory, and be endorsed using Insurance Services <br />Office form CG 20 10 to provide that City and its officers, officials, employees, and agents <br />shall be additional insureds under such policies. For construction contracts, an <br />endorsement providing completed operations to the additional insured, ISO form CG 20 <br />37, is also required. <br />6.02 Each such policy shall apply separately to each insured against whom claim is made or
