ATTY/RESO.0090/PC RESO RECOMMENDING AMENDMENTS TO ARTICLE 59 – COMMERCIAL CANNABIS ACTIVITY <br />REV: 09-10-2020 PR <br />Page 2 of 8 <br /> <br />WHEREAS, on August 27, 2018, the City Council of Redwood City introduced <br />amendments to Article 59 of the Zoning Ordinance allowing delivery centers and indoor <br />nurseries in the Commercial Office (CO) Zoning Districts upon approval of a Conditional <br />Use Permit and with a 600 ft. buffer from protected uses; and <br />WHEREAS, on August 24, 2020, the City Council of Redwood City held a duly- <br />noticed study session on retail cannabis and on said date the study session was held, <br />public comment was opened and closed, and all interested members of the public were <br />afforded an opportunity to be heard; and <br /> <br />WHEREAS, on September 15, 2020, the Planning Commission held a duly- <br />noticed public hearing on the proposed zoning ordinance amendments and on said date <br />the public hearing was opened, held, and closed and all interested members of the public <br />were afforded an opportunity to be heard; and <br /> <br />WHEREAS, the proposed amendments to Article 59 of the Zoning Ordinance would <br />permit retail cannabis uses in the Downtown Precise Plan, the Mixed-Use Corridor, Mixed- <br />Use Neighborhood, Mixed-Used Transitional, Mixed-Use Waterfront, General Commercial, <br />Neighborhood Commercial, Light Industrial Incubator, Industrial Park, and Industrial <br />Restricted Zoning Districts with a 600 ft. buffer from protected uses (the “Zoning Ordinance <br />Amendment”); and <br /> <br />WHEREAS, at the public hearing the Planning Commission considered the staff <br />reports, oral and written, and testimony and materials presented by all those wishing to <br />be heard on the Zoning Ordinance Amendment; and <br /> <br />WHEREAS, the Planning Commission has reviewed and considered the <br />exemption determination under the California Environmental Quality Act (“CEQA”) prior <br />to taking any approval actions on this resolution and approves such exemption. <br /> <br />NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF <br />REDWOOD CITY DOES RESOLVE AS FOLLOWS: <br />Section 1. The recitals set forth above are true and correct, and are hereby <br />incorporated herein by this reference as if fully set forth in their entirety. <br />Section 2. The Planning Commission hereby finds that the proposed Zoning <br />Ordinance Amendment is in the public interest and consistent with the Redwood City <br />General Plan as described in the staff report. <br />Section 3. This proposed Zoning Ordinance Amendment has been reviewed with <br />respect to applicability of the California Environmental Quality Act ("CEQA") and the State
