ATTY/RESO.0090/PC RESO RECOMMENDING AMENDMENTS TO ARTICLE 59 – COMMERCIAL CANNABIS ACTIVITY <br />REV: 09-10-2020 PR <br />Page 4 of 8 <br /> <br />EXHIBIT “A” <br />Article 59 <br />Cannabis Cultivation and Commercial Cannabis Activity <br />Sections <br /> 59.1 Purpose. <br /> 59.2 Applicability. <br /> 59.3 Definitions. <br /> 59.4 Permitted Commercial Cannabis Activity. <br /> 59.5 Minimum Distance Requirements. <br /> 59.6 Cultivation of Cannabis for Personal Use <br />59.7 Violation – Penalty. <br /> 59.8 Public Nuisance. <br /> <br />59.1 Purpose. <br />This Article establishes regulations governing cultivation, possession, <br />manufacture, distribution, processing, storing, laboratory testing, labeling, transportation, <br />or and sale of cannabis and cannabis products, whether for medicinal or adult use. The <br />City finds it necessary to establish such regulations in the interest of the public health, <br />safety and welfare to regulate all cannabis-related activities. <br />59.2 Applicability. <br />This Article shall apply to the establishment of all land uses related to cannabis <br />and cannabis products, whether for medicinal or adult use. <br />59.3 Definitions. <br />For the purposes of this Article, the following words and phrases shall have the <br />following meanings: <br />A. “Cannabis” means any or all parts of the plant Cannabis sativa Linnaeus, Cannabis <br />indica, or Cannabis ruderalis, whether growing or not, the seeds thereof, the resin, <br />whether crude or purified, extracted from any part of the plant; and every compound, <br />manufacture, salt, derivative, mixture, or preparation of the plant, its seeds or resin. <br />“Cannabis” also means the separated resin, whether crude or purified, obtained from <br />cannabis. “Cannabis” does not include the mature stalks of the plant, fiber produced <br />from the stalks, oil or cake made from the seeds of the plant, any other compound, <br />manufacture, salt, derivative, mixture, or preparation of the mature stalks (except the <br />resin extracted therefrom), fiber, oil, or cake, or the sterilized seed of the plant which <br />is incapable of germination. “Cannabis” shall not include industrial hemp, as defined <br />in Health and Safety Code Section 11018.5.
