The provisions of this Article apply when any person requests Reasonable Accommodation, based on the disability of residents, in the application of land use or zoning regulations and procedures which may be acting as a barrier to fair housing opportunities. The provisions for Reasonable Accommodation are solely for residential uses. 56.4 - Submittals. Applications for Reasonable Accommodation must be filed with the Community Development Department, Planning Division, by the owner of the property affected or his agent. The application must include such description or drawings and other reasonable, pertinent information as may be required by the Zoning Administrator or other appropriate reviewing authority, as the case may be. 56.5 - Process for Review. A. An applicant shall submit an application and all supplemental documents in accordance with Section 56.4. B. Upon submittal of an application including materials described in Section 56.4, the Zoning Administrator will review the application if there is no accompanying land use or development application. If the Reasonable Accommodation request is submitted with another application land use or development application, then the reasonable accommodation request will be reviewed and acted on concurrently by the appropriate reviewing authority for the land use or development application. C. A hearing is not required for a Reasonable Accommodation request; however, to the extent a hearing is required for any accompanying land use or development application, the Zoning Administrator or other appropriate reviewing authority shall include the Reasonable Accommodation request as part of the hearing. D. The zoning administrator or other appropriate reviewing authority shall issue a Notice of Official Action or Notice of Final Decision, as applicable. 56.6 - Action. The zoning administrator or other appropriate reviewing authority may take the following actions in response to a reasonable accommodations request: A. Request additional information within thirty (30) days of application submittal. B. Approve as submitted or with modifications and/or conditions. C. Deny. The notice of official action or notice of final decision, as applicable, shall be provided to the applicant within forty-five (45) days of application submittal (or within forty- five (45) days of receiving additional required information). 56.7 - Findings. To permit the reasonable accommodation, the zoning administrator or other appropriate reviewing authority must make all of the following findings:
