ATTY/RESO.0141/PC RESO AMENDING PROPOSED ZONING ORDINANCE CHANGES <br />REV: 12-03-2020 PR <br />Page 17 of 18 <br />56.3 - Applicability of Provisions. <br />The provisions of this Article apply when any person requests Reasonable <br />Accommodation, based on the disability of residents, in the application of land use <br />or zoning regulations and procedures which may be acting as a barrier to fair <br />housing opportunities. The provisions for Reasonable Accommodation are solely <br />for residential uses. <br /> <br />56.4 - Submittals. <br />Applications for Reasonable Accommodation must be filed with the Community <br />Development Department, Planning Division, by the owner of the property affected <br />or his agent. The application must include such description or drawings and other <br />reasonable, pertinent information as may be required by the Zoning Administrator <br />or other appropriate reviewing authority, as the case may be. <br /> <br />56.5 - Process for Review. <br />A. An applicant shall submit an application and all supplemental documents in <br />accordance with Section 56.4. <br />B. Upon submittal of an application including materials described in Section 56.4, <br />the Zoning Administrator will review the application if there is no accompanying <br />land use or development application. If the Reasonable Accommodation request <br />is submitted with another application land use or development application, then the <br />reasonable accommodation request will be reviewed and acted on concurrently by <br />the appropriate reviewing authority for the land use or development application. <br />C. A hearing is not required for a Reasonable Accommodation request; however, <br />to the extent a hearing is required for any accompanying land use or development <br />application, the Zoning Administrator or other appropriate reviewing authority shall <br />include the Reasonable Accommodation request as part of the hearing. <br />D. The zoning administrator or other appropriate reviewing authority shall issue a <br />Notice of Official Action or Notice of Final Decision, as applicable. <br /> <br />56.6 - Action. <br />The zoning administrator or other appropriate reviewing authority may take the <br />following actions in response to a reasonable accommodations request: <br /> <br />A. Request additional information within thirty (30) days of application submittal. <br />B. Approve as submitted or with modifications and/or conditions. <br />C. Deny. <br /> <br />The notice of official action or notice of final decision, as applicable, shall be <br />provided to the applicant within forty-five (45) days of application submittal (or within forty- <br />five (45) days of receiving additional required information). <br /> <br />56.7 - Findings. <br />To permit the reasonable accommodation, the zoning administrator or other <br />appropriate reviewing authority must make all of the following findings: <br />
