unless the addition is minor, as determined by the Community Development & <br />Transportation Director or his/her Designee. <br />a. Project Approval Authority. <br />I. The Approval Authority for Large Projects within the Transit District <br />shall be the City Council with recommendation by the Planning <br />Commission. The decision of the City Council shall be final. <br />II. The Approval Authority for all other Large Projects shall be the Planning <br />Commission. The decision of the Planning Commission shall be final <br />unless appealed or called up to the City Council (Article 41.4.C of the <br />Zoning Code). <br />III.Project Approval.The Approval Authority shall evaluate Large <br />Projects be granted by the Planning Commission based on the level of <br />compliance with the applicable DTPP Standards and Guidelines. The <br />Planning Commission Approval Authority shall hold at least one Public <br />Hearing on the application. Legal notice of the Public Hearing shall be <br />given as provided in Article 49 of the Zoning Ordinance. The Planning <br />Commission’s decision is final unless appealed to the City Council by <br />an aggrieved person or party, or “Called Up” by the City Council. <br />1. Standards and Guidelines Compliance. The Planning <br />Manager/Designee shall review the project application for <br />conformance to the DTPP Precise Plan and the applicable <br />Standards and Guidelines and shall make a recommendation <br />on the Project to the and shall recommend that the Planning <br />Commission Approval Authority grant approval to projects <br />which he/she deems to comply fully with all applicable <br />standards and guidelines. The Planning Commission Approval <br />Authority shall will evaluate the staff recommendation as well as <br />any other information presented at the Public Hearing in making <br />a decision on the project. <br />2. Standards Compliance Only. For projects which the Planning <br />Manager/Designee deems to conform to the Standards, but not <br />the guidelines, he/she shall seek a recommendation from the <br />Architectural Advisory Committee (AAC) or successor <br />committee on the acceptability of the aspects of the project <br />which do not conform to the Guidelines. Considering the AAC’s <br />input, and considering whether the aspects of the application <br />which do not conform to the guidelines nonetheless adequately <br />promote the overall intent of the DTPP, the Planning <br />Manager/Designee shall make a staff recommendation on the <br />Project to the Planning Commission Approval Authority. The <br />Planning Commission Approval Authority shall will evaluate the <br />AAC ARC and staff recommendations as well as any other <br />information presented at the Public Hearing in making a <br />decision on the Project. <br />3. Lack of Standards Compliance. Projects deemed by the <br />Planning Manager/Designee to not comply with the standards <br />shall be rejected. <br />b. Type of Approval. Applications approved by the Planning Commission <br />Approval Authority shall be granted a Planned Community (PC) Permit. The <br />Page 4 of 45
