<br />ATTY/AGR/2022.389/HARBOR VIEW PROJECT DEVELOPMENT AGREEMENT <br />REV: 10-28-2022 VR 11 <br />Project. Such evidence may consist of a cancelled check and a letter from the Sequoia Branch of <br />the YMCA acknowledging payment has been made, or other evidence reasonably acceptable to <br />City. <br />Section 3.5 Transportation Improvements and Contributions. <br />A. US 101/SR 84 Interchange Public Benefit Contribution. Developer shall <br />pay to City One Million Dollars ($1,000,000), plus the product of $1,000,000 times the percentage <br />increase in CCI between the Effective Date and the date on which such payment is made, which <br />funds shall be utilized by City fo r the US 101/SR 84 interchange improvement project (“US <br />101/SR 84 Interchange Public Benefit Contribution”). Developer shall make the US 101/SR <br />84 Interchange Public Benefit Contribution to City prior to the issuance of the first office building <br />permit for the Project. The US 101/SR 84 Interchange Public Benefit Contribution shall be in <br />addition to the US 101/SR 84 Fair Share Contribution. <br />B. Alternative Transpo rtation Contribution. Developer shall pay to City One <br />Hundred Thousand Dollars ($100,000), plus the product of $100,000 times the percentage increase <br />in CPI between the Effective Date and the date on which such payment is made, which funds shall <br />be utilized by City to support alternative transportation modes east of Highway 101 including ferry <br />terminal development and service (“Alternative Transportation Contribution”). Developer <br />shall make the Alternative Transportation Contribution to City prior to the issuance of the first <br />office building permit for the Project. <br />C. B lomquist Bridge Project Contribut ion. Developer shall pay to City Six <br />Million Five Hundred Thousand Dollars ($6,500,000) plus the product of $6,500,000 times the <br />percentage increase in CCI between the Effective Date and the date on which such payment is <br />made, which funds shall be utilized by City to fund Blomquist bridge related infrastructure <br />improvements, which may include installation of water lines under the proposed new bridge (the <br />“Blomquist Bridge Project Contribution”). Subject to the credits described in Section 6.4 <br />below, Developer shall make the Blomquist Bridge Project Contribution to City prior to the <br />issuance of the first office building permit for the Project. Payment of the Blomquist Bridge <br />Project Contribution shall be deemed to fully satisfy Developer’s obligations under the FEIR with <br />respect to the East 101 fair share contribution. <br />D. O ld Seaport Bicycle and Pedestrian Enhancements. Developer shall <br />construct enhanced improvements along the Project frontage at Old Seaport in the areas described <br />in Exhibit H, Old Seaport Scope of Work, attached hereto and incorporated herein by reference <br />(“Old Seaport Pedestrian and Bicycle Enhancements”). The community benefit of the Old <br />Seaport Pedestrian and Bicycle Enhancements are estimated as of the Effective Date to have a <br />value of Four Million Seven Hundred Thousand Dollars ($4,700,000). The Old Seaport Pedestrian <br />and Bicycle Enhancements shall be constructed with the Project and shall be included in the <br />Subdivision Improvement Agreement defined in Section 3.6. <br />E. Blomquist Water Main Improvements. Subject to the credits described in <br />Section 6.4 below , prior to issuance of the first certificate of occupancy for the first office building, <br />Developer shall construct approximately 400 LF of 20” water main from the intersection of Maple <br />Street and Blomquist Street to the Project’s western property line adjacent to the County Jail at
