If year five is a <br />poor weather year for summer and fall-blooming <br />annual plants and reference populations show a <br />decline, this criteria can be measured in the next <br />year occurring with average or better rainfall; and <br /> contingency measures for mitigation elements <br />that do not meet performance criteria. <br /> <br />The HMMP shall be prepared by a qualified plant or <br />restoration ecologist. Approval of the HMMP by the City <br />will be required before project impacts on Congdon’s <br />tarplant occur. <br /> <br />Impacts on Nesting Birds <br /> <br />MM BIO-1.4: Avoidance of the Nesting Season. To the <br />extent feasible, commencement of demolition and <br />construction activities shall be scheduled to avoid the <br />nesting season. If demolition and construction activities <br />are scheduled to take place outside of the nesting <br />season, all potential demolition/construction impacts on <br />nesting birds protected under the MBTA and California <br />Fish and Game Code shall be avoided.
