REV: 10-04-24 JB <br />Exhibit “A” <br />SCOPE OF SERVICES AND FEE <br />As part of the Belmont Slough Emergency Levee Repair (“Project”), biological monitoring <br />was required to comply with State and Federal environmental regulations. Following City <br />emergency procurement procedures, Montrose Environmental Solutions, Inc. provided <br />the necessary monitoring during the construction of the levee repair. Due to unforeseen <br />issues that delayed the construction work, monitoring services were required for longer <br />than was covered by the initial Agreement. The original scope included 20 days of <br />construction, with monitoring for eight hours per day. The final construction lasted 24 <br />days, averaging 10-12 hours per day. <br />This Amendment No. 1 includes all of the Biological Compliance Surveys, Monitoring, <br />and Reporting services covered by the initial Agreement, with the additional hours <br />required to support the construction through final completion. Specified rates in the initial <br />Agreement remain in effect. Specifically, during Project construction, Consultant provided <br />daily biological monitoring, observing dewatering activities, and rescuing and relocating <br />stranded aquatic life in the dewatered area. Consultant maintained a record of all fish <br />and/or aquatic wildlife rescued and moved during dewatering. Consultant maintained a <br />monitoring log to record monitoring activities. The log provides brief notes after each visit <br />that include the name of the biologist onsite, dates and times of monitoring, description <br />of activities monitored, species observations and relocations, and recommended <br />protective measures if regulated species were observed. Photographs were also taken to <br />document site conditions during monitoring. <br />Following Project completion, Consultant will prepare a brief memorandum (memo) that <br />will include survey methods, personnel, species observations, and monitoring results. The <br />daily monitoring log and representative photos will be included with the memo as <br />attachments. Consultant will submit the draft memo within one (1) week following <br />execution of this Amendment No. 1. Following City review and comment, Consultant will <br />revise and submit a final memo to the City within one (1) week of receiving comments. <br />Deliverables: Monitoring log for all construction monitoring activities (submitted <br />with memo) <br />Draft and Final Memo submitted to the City (PDF) <br />ATTY/AGR.2024/Amend.
