<br />REPORT <br /> <br />6.1J <br />age 1 <br /> <br />To the Honorable Mayor and City Council <br />From the Ci Mana er <br /> <br />November 23, 2009 <br /> <br />SUBJECT <br />Redwood Shores Lagoon Maintenance Dredging Project-License and Indemnity <br />Agreement with Keech Properties, LLC <br /> <br />RECOMMENDATION <br />Approve License and Indemnity Agreement between Keech Properties, LLC, a <br />California limited liability Company ("Licensor"), and the City (Licensee") for a temporary <br />non-exclusive license and indemnity to work within Area H in Redwood Shores to <br />deposit dredge material on certain portions, referred to as "Borrow Ditch". <br /> <br />BACKGROUND <br />The City of Redwood City proposes to dredge certain portions of the lagoons in <br />Redwood Shores to improve the water quality and circulation in accordance with <br />approved regulatory permits. In reviewing the various options in disposing the dredge <br />material, an opportunity arose in depositing the dredged material in Area H as part of <br />"The Preserves" wetland restoration by the developer, Keech Properties, LLC. <br /> <br />Re..using dredge materials in Area H helps to keep the San Francisco Bay clean by <br />avoiding the more-typical dumping of dredged material into the bay near Alcatraz or the <br />transporting and disposing the material at a landfill. The developer will breach the <br />existing levee next year, in order to restore natural tidal action. This in turn will provide <br />for the natural evolution of the site to tidal wetlands, natural vegetation, and habitat for <br />many species including the endangered California Clapper Rail and the Salt Marsh <br />harvest mouse. <br /> <br />In approximately five years, the developer intends to transfer ownership of the wetland <br />area to the Don Edwards Wildlife Refuge which is part of the U.S. Fish and Wildlife <br />Service. The developer has no vested interest in receiving the dredge material but is <br />willing to assist the City in re-use of the dredge material in Area H. <br /> <br />This beneficial re-use of dredge material follows what is currently being done on Bair <br />Island wetland restoration. <br /> <br />On October 12, 2009, Council approved and awarded the Redwood Shores Lagoon <br />Maintenance Dredging Project to Aquatic Environments, Inc. in the amount of $712,700. <br />The dredging is anticipated to start in late November early December after approval <br />from the Corps of Engineers of the contractors Dredging Operation Plan. <br /> <br />As a condition of allowing the City to deposit the dredged material in the borrow ditch of <br />Area H, Keech Properties, LLC has requested that the City approve a <br />
