If the agreement is
considered a project, it is exempt under CEQA Guidelines Section 15301(c) (Existing facilities) Class 1
because it consists of the operation, repair, maintenance, permitting, leasing, licensing or minor alteration
of existing public or private structures, facilities, mechanical equipment, or topographical features
involving negligible or no expansion of existing or former use, in that it involves the construction,
installation, maintenance, and operation of fiber optic network facilities within the City’s public right-of
way.
PUBLIC NOTICE
Public notification was achieved by posting the agenda, with the agenda items being listed, at least 72
hours prior to the meeting.
ALTERNATIVES
The City Council may choose not to approve the agreement, or direct staff to renegotiate the terms of the
agreement. However, companies with valid CPCN have a franchise right to use the public right of way, and
are allowed to operate, even without the agreement provided that they receive the appropriate permits
from the City regulating each individual installation.
ATTACHMENTS
Attachment A – Agreement with Astound Broadband, LLC
REPORT PREPARED BY:
Alex Chan, Senior Civil Engineer
achan@redwoodcity.org
(650) 780-7307
APPROVED BY:
Jeff Schwob, Community Development & Transportation Director
Melissa Stevenson Diaz, City Manager
6.E. - Page 3 of 23
172
